Reversed into! Other driver now claiming rear end shunt advice please.

My brother was stationary in traffic when the driver in front reversed into him. the other driver got out of her car and apologised saying she was looking for a parking space. She gave him her company card with a name and contact number on it. She said there will be no problem as it is a company car. The next day she rang him, apologised again and gave him her company insurance details.
That was five days ago, he had contacted his insurance company and told them what happened. They have now comeback to him saying the other driver is claiming that he drove into the back of her and she has two witnesses. The phone number she gave goes to answer phone and she has not returned his call. As you can imagine he is totally at a loss as to what to do next.
Advice please!

He has to state his case to the insurance company. Answer the letter stating what happened again and ask for evidence from the witnesses. Although the insurance company will sort out the repairs he really needs to not have a claim on his own insurance and have the claim on the other party's insurance.:footie:

Aren't some people terrible. Can you get any CCTV footage? Then you could report them to the police for fraud?0

He has contacted the local council in the hope they have it on CCTV as it was in the local shopping area and is waiting for a call back.0 -

Great! If that happens, don't tell them you have the CCTV footage right away. Let them give a really clear, detailed and eloborate description in writing of exactly what they say happened. Let them confirm in writing that they in no way reversed into you and that you drove into them. Get them to describe exactly where the witnesses were standing and get it all in writing, nice and clear and with no wriggle room for going back on their story.
If you can, dispute it and get them to sign an affidavit confirming that was exactly what happened - witnesses and all.
Do all of this via your insurance company and make sure nothing you do can be interpreted as putting words in their mouth or leading them on. You simply want to know why they are making a claim against you.
Then, see what your insurance company thinks, based on the CCTV footage.
I can't stand liars.

Nice idea, but how do you get the insurance company to do all that?
You can hope they do an in depth telephone interview in reality it will be quickest and cheapest.0 -
The damage to your brothers car will tell an investigator all they need to know.
Basically, when someone runs into the back of someone else, they've usually been braking which lowers the front of the car. Damage to the rear vehicle (your brothers) will mostly be concentrated on the upper half of the front end.
When someone reverses into your car it is hit flat on so damage is more uniformly spread over the full height of the vehicle.0 -

She apparently stopped in traffic so he stopped behind her, she then drove on so he drove on, she then stopped in traffic again so he stopped again. She then selected reverse and reversed into him. Got out of the car and said she was sorry but she had been looking for a parking space, he tells me there were no free spaces on the section of road they were on. So yes she had specifically reversed.0 -
This is the main reason for me today ordering a incar video recorder.

One way insurance companies catch people out is if there story is widely inconsistent, or exactly the same every time they tell it. So she will be caught out if she is stressed.I'm not cynical I'm realistic
