Argos Sent Me a PS3 - What to do?

    Theft is defined as '..dishonestly appropriating property belonging to another with intention of permenantly deprive them of it...'

    You entered into an agreement with whoever for supply of the goods. There may be bad practice on the part of the supplier but mistakes do happen. If you therefore retain the goods and dispose of how you see fit without 'offering payment' or allowing the company to rectify their mistake you may be culpable as you have assumed ownership..... give them the opportunity to do so.

    The bottom line is would you want the same done to you if you were in business?

    It's correct that when you want to return an item because you've changed your mind in having it then you have to deliver it your own expense, if the item was faulty then the company is expected to refund any postage costs.

    Agreed - there seem to be a lot of people who've had 2 or more PS3s "mysteriously" turn up out of the blue . Read as - put in a load of preorders hoping 1 or 2 turn up (with the intention of sticking them on eBay), on launch day realise its not selling well , all the consoles you've ordered turn up and you blame the shop or Royal Mail .

    That drives me nuts when delivery people leave stuff with neighbours, this is why delivery drivers end up doing their job, they're thick.

  • Unsurprisingly, prices go up when shops have to recoup profits from unreturned goods. Clerical error or no, the PS3 isn't yours, I suggest you either pay for it or return it. Would you buy goods off the back of a lorry?

    I am quite amazed by the number if people who would keep it under these circumstances - you bunch of crooks!! :P

    Im sorry,but i would keep it in the box and if they contact you or take money out of you account ,i would give it back but if they dont,KEEP IT :j Just call it a bonus:D And i bet the ones an here that are saying to take it back,are just sick because youve got something for free,and i bet if they had it they wouldnt take it back,noone in theyre right mind would :)

    If I wanted "hot" goods, I know a man who can ;) So i'm not jealous :D

    On a serious note, this ISN'T unsolicited goods, as the goods were sent by Argos in the (mistaken) belief that they were wanted and paid for. Playman, I don't think you are as good at understanding the law as you are at quoting it - I think Argos' Legal Dept would be though.

    Its akin to an employer overpaying your wages, its a settled fact that the employee has no right to them - in equity the PS3 still belongs to Argos - its a risk to take that if you sell it, legally you could be pursued by Argos for the money - what would you do then? (because I am pretty certain they would get a Judgement against you)
