Advice re selling car with Road Tax

Hi all.

I just sold my car (hooray!). My ad mentioned it had just had MOT and full service last week. However I made no mention of the Road Tax or how much was left. This is because I bought it 3 months ago and fully intended to cancel it on purchase (or let purchaser keep it and reimburse me the £180 or so).

Now that I've sold it the purchaser says he assumed the road tax was included in the price. Not that he wouldnt have bought the car, but he would have offered less. He wants to keep the road tax himself.

I argued that I specifically did not mention it in the ad to show that it wasnt included in the price. And certainly didn't want to give him a present of £180 (9 months free).

All amenable, but want to do the right thing.

Who is right? (legally / done thing)

    If you left in on when he looked at it, it would seem fair to expect it was included. Sold as seen, and he saw it.

    But isn't it the done thing to sell a car with very little Road Tax remaining, or specify in ad how much is left (thereby factoring it into the price)?

    At this point I would be assuming you were trying to scam me, whether that was true or it was just an oversight

    I am not sure you have to sell him the car if you think you can get the same again.

    The best you could hope for would be to try for halves

    If he has paid for the car, the car and tax disc as shown on the day of purchase belong to him, unless otherwised discussed and agreed.

    Although you say you did not mention it you should have stated in your advert that you intended to cash the tax disc in. Most people I've seen advertise have expensive stereo systems as an example but state the original will be put back in as that item is not included in the sale.

    Also, as the buyer has said, if you did not have tax on the car he would of offered a lower price. Other buyers would have done the same.

    Just chalk it up to experience and move on.

    I would expect them to have it out before I go and see the car with potentially a wad in my back pocket.

    As others have said chalk it up to experience. I would expect the tax to be included.

    Agree with the others. As a private buyer I'd expect the tax to be included unless it was explicitly excluded in the advert or at the time of sale. And as has been mentioned the car was sold as seen.
