I know she has every right to refuse entry but her whole reason for refusal was because she didn't want them to come into her home and was willing to rearrange for a more convenient time for her implying that today at 2pm was inconvienient but surely if it is now ok for them to come in for an inspection, they could say it is unreasonable for her to not allow an extra person to tag along to look round with them to save them making another appointment another time for the viewing. they are clearly prepared to be verbaly aggressive with her and there is the threat of breaking into her home i wouldn't have entertained their inspection request and reiterated that that time and date wasn't convientient.0

While I can understand everyone’s emotional support for Marla and anger at the arrogance of the letting agent the edn result has to seriously be considered along with the fact that whatever anyone says about her being a hard-!!! and blocking the door, she is the only one of us who is physically there.
I prosecute landlords and agents for a living and those messages she has been getting have really dug the grave for the agents. They are very clearly threats of a criminal nature, which leaves her with 3 routes.
- Criminal action for harassment.
- Civil action for breach of covenant for quiet enjoyment, and
- Serious complaint to their accreditation body ARLA.
But if she acts rashly at this point she is playing right into the agent’s hands and weakening her very good case.
Emotional responses are not what is required in a legal case.
If she wants to win the fight at the door, then fine, deny access, be a hero. If she wants to take further legal action, then appearing reasonable and squeaky clean and professional in the face of some nasty threats is the best route.
Having stated that they only want to visit to inspect, if they subsequently turn up with a viewer, then they have proven to be liars as well as bullies, and the offences just keep stacking up, all in Marla’s favour.0 -
Hopefully Marlie's friend is with her to witness the "inspection" and then as Ben says, she can calmly pursue the legal options open to her following their outrageous behaviour.
Imagine how this lot behave to vulnerable tenants who don't have access to the internet and aren't able to stand up for themselves. They need to be properly slapped down.They are an EYESORES!!!!0 -
English government flatly refuse to regulate landlords or their agents, which is an abomination in my book. But Wales have just produced a consultation document, that I will lay money on getting passed, that proposes licensing for all landlords and agents.
Not a cash milking exercise but a fast, effective way of taking the rogues off the board. If you breach the standards set by the government you cant run a property unless you pass management over to someone who still has a licence to let. If an agent breaches the standards then they cannot let properties in Wales and get a £50,000 fine.
Everyone should back their proposals, because if Wales can usher it in and it is proven to work, England in the form of Grant Shapps and David Cameron dont have an argument for not doing it.
Actions like Marlie is currently experiencing would put her agents out of business.

Just just truly awful people. On the phone it seemed to me that because Ive given notice that means I cant rearrange anything anymore. They are prob desperate to sell cos she prob cant afford her mortgage without my rent.
Hi Marlie as with everyone else disgusted by how you have been treated and hope you get on well today.
RE the orginal reason for rescheduling, as you are on nights at the mo does that mean that in effect this visit is essentially in the early hours of the morning for you? They wouldn't ask tenant if they could visit at 5am. Don't know if there is any legalities that can help you there.

@Slimsia, what a fantastic idea I had never thought of before. If a tenant is on nights and is happy to allow access "At reasonable times" which is the term used in law, then it begs the legal question, "reasonable" for whom???
If the definition is reasonable for the tenant's working patterns then why not tell the agent you are happy to allow access at a reasonable time, which for me is 5am when I get in from work haha Nice one0 -

As a tenant about to move out of a property with a dodgy LL I'm absolutely appalled at Marlie's situation. As a tenant it can be easy to feel like you're on your own against LLs, LAs, the law and everyone else who makes renting difficult - it's so heartening to see all this support and advice.0
