Urgent Court of Protection Application help please - worried

    Thank you for your comments, I just did what anybody would do for someone they love, try and make them as happy as possible to the end.

    This week started off well, all going according to plan but have now hit a few stumbling blocks. Mum has received a penalty notice from the tax office for not filing a return for the year ending 2010, I never even knew she had to! Am gobsmacked that the letter was addressed to her at my address, those 16 days must have really counted to some people (proves the point that Big Brother is always watching). She had 3 investments totalling a whole £27,000 which gave her an income of approximately £100 per month, I would assume it is this they are interested in.

    I probably need to detail the ins and outs of these as some are income bonds (one matured but not paid out) and some are ISA's, but would I be better posting the details on the investments and/or cutting tax boards?

    They don't like to make this time easy for us, do they?

    The "cutting tax" board should help you out once you have reconciled the Income Tax figures, so you understand the starting point from HMRC's point of view.

    You should get the penalty charge back if you spend some time filling in the appeal form (Your late mother has a good case.)

    the R27 form has recently been "computerised" but in your case it sounds as though your mum was already in the clutches of the self assessment system?

    Thanks for that John, I read your link, what do the tax office expect, us to be able to look into a crystal ball for the information they want?

    The £200 hasn't been paid yet, it's a penalty notice they sent to my mum at my address. I have no idea if they expect me to pay it or not but have written to them to ask what happens next.

    I will post on the cutting tax board to see if anyone can help me make sense of it all, but as it's mum's funeral on Friday I'm not even going to think about it until after that.

    That should buy you time, perhaps months - though the organisation is beginning to recover from its near melt down 4 years ago.

    If HMRC is continually ignored, perhaps by a tax payer who has moved but "forgotten" to inform HMRC, eventually a massive tax bill arrives with a legal notice informing the tax payer they have a short period of time to prove the massive figure is incorrect. [Meanwhile the executor publishes a notice asking for creditors in the London Gazette and obtains probate and creates an enforcement problem for HMRC].


    The initial penalty is normally £100 so perhaps your mum has a missing penalty notice somewhere?

    Did you initiate the contact with HMRC? If not I wonder how they knew to write to your address?

    I hope the funeral all goes to plan.
