    I am so hurt by the comments of the people that have criticised my apparent rude manner when asking a question about a situation i have never been in before and that will cause myself and my family tremendous financial hardship, when has asking for advice been an open invitation for strangers to insult me and have the attitude that it is my fault i am being made redundant. i am sure the purpose of the forum is to assist people who are facing a tremendous change in their lives and are asking others who may have been in a similar situation how they coped or challenged their employer, through the approved channels, regarding their financial package or method of being selected for redundancy.

    So lets hope everyone who have focused on an attitude i was not aware of realises that the message certain contributers to this forum are displaying is one of hostility to a person looking for help.

    so let the righteous people sleep well, what the old saying "if you cant say anything nice......"

    This forum is for people to ask for advice, not demand it. If you post a question on a public forum, you don't get to decide who replies.

    Looks like you have been given a bit of a hard time by some of the other posters. Don't feel bad as I often get asked similar questions (and my profession involves giving people advice on employment matters). Do you and this other person do the same job or both carry out work of a particular kind? If not, then there is probably nothing you can do about it (as you are arguably not in the same situation).

    If you are doing the same job then then may be an issue here and you want to be asking (with the help of your Union rep) what process the employer went through when deciding who to keep on and for how long and why (you want to make sure it isnt the employer sneakily trying to keep certain people on as redundancy notices can always be rescinded you see). I would add that it is also not unusual for employers to stagger finishing dates depending on their business needs (as you would expect).

    In response to the"kick his bod when he is down" vultures who savaged my damaged carcass I have never been rude or called anyone jealous. 2 replies which attempted not to give me the lickings of a dog were posted within 30 minutes of my last post.

  • Differing end dates are not uncommon. Redundancy is based on the position becoming redundant, not the person. In your case your employer believes that your role will no longer be required in 12 weeks. At which point any redundancy payment will become payable if eligible. Your colleague's role ends in 26 weeks. You have both probably been considered under the same consulatation period.

    You should have been notified that your role was at risk and the length of the consultation period, usually 90 days, the earliest that redundancy normally occurs is at the end of the 90 day consultation period. But there is no maximum, I've known people to be given a 12 months notice of redundancy. The problem with long redundancy notice periods is that the employer can change its mind and rescind the redundancy. Fine if you want to stay, not great if you have lined up a new job and are looking forward to the redundancy payment. If you still want to leave and the role is no longer redundant, you have to resign.

    Make it clear to your employer, that you would be willing to work a bit longer and maybe you will get an extension. But be aware that if circumstances change that the redundancy payment could change. I knew someone, who opted for redundancy, then stayed on, the redundancy was withdrawn. The following year they were made redundant and only received statutary amount, which was 25% of what they had been offered previously.

    So instead of worrying about how much notice your colleague has got, start job hunting actively. If your package includes any cv writing courses, make use of it. Whilst it it is not a great time to be made redundant, you have to try and make the best of it.

    After many years of rounds of being at risk watching colleagues being made redundant and being made redundant myself, most people I know, say it was for the best in the long term, it can take a while to feel that way. But they have eventually found something better.

    Dear Arthur

    I am sorry that you feel victimised by the responses have have received to your first post ....however YOUR responses give the pointer as to why your colleague has been given a longer period of notice than you have been given.

    Might I suggest that you look carefully at the responses you have received, and ask yourself the question - if you were in the position that your senior is in - who would you keep on - the person who works quite cheerfully - or the person who queries each and every request?

    The forum rules work both ways pal. You don't get to be rude to people then cry foul when folk give you some back.
