I get 12 weeks notice, he gets 26??

I work for a local council
I am being made redundant on 1/8/2012 and will get 12 weeks notice.
A fellow worker was made redundant on 27/6/2012 but has been told he will be paid up to 31/12/ 2012.

We both have the same number of years service, so when i queried this decision with my boss he tells me we need this "fellow worker" as there are lots of problems in the section he works in so we need his expertise!!!

Well enough was enough so i have put in an official grievance and informed my union

    This happened at my place... nothing was raised as the individual was assessed to be needed for 5 months longer to help transition but then would receive redundancy.

    Lucky him.

    Bottom line is your just jealous yougot notice more than enough i think.. just he got a bit more cause is needed.

    With rudeness and attitude like that good luck with getting replies (although it does give a good idea why your fellow worker was chosen over you to stay longer)

    I am confused - Unlike my LA.

    They would simply serve notice later in the day, after all he can leave now at anytime and claim full redundancy if he gets a new job.

    Unless he has signed a CA and is being paid more for the inconvenience?

    Has he definitely been served notice?

    So he hasn't been served notice (that sounds more like LA). He is "at risk" and will be served notice 12 weeks before his end date. You are on notice and he isn't.

    It *could* be they have offered voluntary to him with enhanced terms. It is to their detriment to give longer notice period so I can't see them doing this TBH.

    Only your union can help - but even then they can't talk about other people's situations.

    Out of interest why does it bother you? I have been "at risk" for so long and I'd rather be free to go if that is their decision, working knowing an end date is a bit like a death row to me.

    If you have "informed your union" why on earth are you asking, rather rudely I might say, a bunch of strangers on a website who don't know anything about your employer? Why haven't you asked your union?

    They can make people redundant at different times if they need to keep people.

    Unless you can convince them they have kept on the wrong person I can't see they have done anything wrong.

    Notice is a minimum not a maximum.


    and unless it is writen into the contract/notice they can lose the redundancy payments if they resign early unless they can give counter notice.
