Help with Paypal please.

Hi all.
Firstly I have benn with ebay for 4 yrs and paypal for 2 yrs. I have 400 pos feedback 100% with ebay and 48 with paypal, A perfect unblemished account on both.
Sunday passed I won a car for my daughter on ebay. I instantly paid £160 deposit to the seller via paypal.
I collected the car yesterday(tuesday 20th) paid the remaining balance and off I went.
This morning I had a phone call from the seller saying paypal had held back the deposit for the car due to some suspected fraudulent goings on with my paypal account. They also suggested to the seller that he contacts the police and report the car as stolen!
To cut a long story short, paypal have limited my account because my brother who lives on the same street, with the same surname, same post-code and similar email account, has a dispute with a seller on his paypal account. He sold a phone to a buyer in Italy who claimed to have only received the sim card, my brother had proof of postage which also confirmed the weight of the package, yet paypal still favoured the buyer and refunded £100 to him. Paypal are now wanting the £100 off my brother which he is not prepared to pay.

Sorry this is so confusing. Now what paypal are saying is because my brothers account is so similar to mine, this as created a link between them and therefore my account is also limted, and the only way I can get my account un-limted is for my brother to resolve his dispute.
I just cannot beleive they can do this to me. Paypal have £240 of mine, it is my brother who has a dispute with them, not me. Just because our accounts are similar I get punished. I have been on the phone to paypal and there is nothing else I can do until my brothers account is sorted, which it is not going to be, so I have to suffer and paypal keep my money.
Sorry for the poor english by the way.
My question is this, what can I do to get my money back basically, would I be able to take paypal to court, as this happened to anyone else?

    paypal say your brother owes them £100. you say your brother had proof of postage but did he send it by a trackable method? post to a confirmed address? and does he have proof of delivery?

    you also say paypal owe you £240, does this include the £160 deposit you paid for the car plus £80 you also had in your account?

    i don't understand why paypal have taken £240 from you if your brother only owes them £100

    It seems stupid that you are effectively being punished for something that has nothing to do with you.

    If you speak to your brother and explain what has happened will he not just pay what he owes so that you both get your accounts back?

  • How do they know he's your brother. There's alot of Smiths round here.

    Are PayPal by any chance on drugs? Personally I wouldn't have admitted to knowing who your brother even was.

    There's something like 15,000 Smiths in our recent phonebook.

    this is a paypal dispute not a royal mail dispute

    paypal requirements for seller protection are send to a confirmed address and obtain online trackable proof of delivery, amongst other things

    the reason paypal say his brother owes then £100 is probably because he failed to cover himself for seller protection

    There's no way brother could have complied with paypal's seller protection policies by sending to Italy.
