Seems to me the shoe is actually and very much on the other foot...
The seller is selling access to digital content by email. This violates eBay's Prohibited or Restricted items Policy.
OP if you ring eBay and state that you bought the item without realising that the code would be emailed rather than posted, that you haven't received it, and also inform them repeatedly that the item is prohibited on eBay and that eBay have a responsibility to remove the listings as well as refund you.

You don't pay eBay, you pay paypal. PayPal won't refund.
