I read "in most cases" relating to "eBay transactions go through with no problems at all" then the But, and then the "safeguards in place to make sure that if Anything does go wrong etc etc.
If the transaction was found to be not allowed and void. Ebay would automatically refund the original payment, surely.
Personally I would argue the point on the phone and at least try to get back my £20-£30 and try to get this loop-hole closed.

    Tangible? Or physical?

I think an xbox live code is perfectly tangible - and they should be able to prove that they've provided it to OP.
Downloads are neither tangle nor physical. Paypal specifically list items must not be intangible. So therefore a digital download is not tangible.

If the transaction was voided on ebay, then no, they won't refund as a matter of course. You then should go through the dispute process on Paypal. And in this case, the OP will not be covered for a digital download. You make the payment via Paypal not Ebay.

but through the Ebay Checkout system.
and Paypal might have been the only method of accepted payment.
I can't say I have ever had this problem to deal with, so I am just hoping and siding with the OP

    Argue however much you like.

Intangible items are not covered by Paypal protection for buyers.

Ebay will not refund a void transaction as a matter of course. They direct you to Paypal.

Those are facts. You can get on the phone/livechat or email as much as you like. This 'loophole' has been well documented on the internet for many years. It's not a new thing. ;)

But the OP's not talking about a download, they're talking about (I assume) a code. What they paid for was entirely tangible - an email with the code attached. There's nothing vague about it...either they sent the email, or they didn't. If they did, they can provide a copy to paypal, if they didn't, they'd have to pay up, surely.

An email with a code attached is not a tangible item as far as Paypal Seller Protection is concerned.
    Hi

" i suggest you start your paypal and ebay case as you are not covered for digital goods, good luck, no-one tales to me like that, your banned, ive also emailed all xboxlive sellers to ban you as

    Thx in advance.

I took this as a digital download, i.e. via email. But this isn't absolutely clear.

But judging by the response the OP got, I am assuming the seller knows full well that this type of thing is not covered, hence the response. Perhaps the OP can clarify how the 'code' was sold.

    In case of any confusion:
13.3 What type of payments are eligible for re-imbursement under PayPal Buyer Protection?

PayPal Buyer Protection only applies to PayPal payments for certain tangible, physical goods. Payments for the following are not eligible for re-imbursement under PayPal Buyer Protection:

    intangible items

    services

real estate (including, without limitation, residential property)

    businesses

vehicles (including, without limitation, motor vehicles, motorcycles, caravans, aircraft and boats),

    custom made items

travel tickets (including, without limitation, airline flight tickets)

items prohibited by the PayPal Acceptable Use Policy

items that violate eBay’s Prohibited or Restricted Items Policy

    licences

    access to digital content

    industrial machinery used in manufacturing

items equivalent to cash (including, without limitation, gift cards)

Items purchased using Zong, Website Payments Pro or Virtual Terminal

    Personal Transaction payments

So, an intangible item which also falls under one of Ebays prohibited/restricted (assuming it was a code via email).

Mcjordi, could the code be an e-code or is it always on a card. If the latter then the OP does have a case.
