How many of those successful cases from Excel were from no-shows where the defendant didn't even know they got court papers as Excel used an old address (or even an admin error put the wrong address in the field)?

It is a shame that Mr Ibbotson would not have been a party to the proceedings involving Simon Renshaw-Smith's explanation to Judge McIlwaine for having issued proceedings without cause. That, I would have paid good money to have been present at. Certainly "Miss Coates" was sent away with her tail firmly between her legs and I doubt we will see her or SR-S on the court circuit for a while.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

It's probably fair comment to say that BPA won half of the issued cases that proceeded as far as a hearing BUT we don't know for sure whether all those cases were for parking tickets. Out of the 845 cases probably some of them were for things other than parking. Don't know if any of those non-parking cases might have been in the final 49 cases.

Also there is the DeVere factor. They account for quite a large percentage of the issued cases. It is believed that their cases seem to receive an unusually sympathetic hearing in their local county court. Possibly this is just because as repeat players and regular court attendees they've managed to build up a certain level of trust. Others have suggested more sinister explanations to do with the guy behind Devere, Lee Kirsch, being a magistrate or former magistrate - but that just seems like speculation.

For those in need of a damned good chuckle the full transcript of VCS v Ibbotson is over on Pepipoo. It's also on CAG but you have to be a member there in order to download it.

Of course, should these pumpkin-heads try Court, the defendant has the right to have the case moved to their local Court, thus taking the case away from the BPA's favourite JPs.

Indeed the defendant has the right to a hearing in his local court. Unfortunately, experience suggests that cases are carefully selected so that they are effectively all local and with the closure of Poole County Court there is only one court to be used. Devere have folded on cases where good defences are filed.

"BPA's favourite JP's?" - Mr Kirsh may or may not be a former JP and may, now, be connected or not with Devere (who is the mysterious Steve Williams?) but it is DDJ's, usually, that preside over small claims hearings.

I received a reply from my MP today regarding the false information the BPA gave to government about the 36000- 90000 court cases. She was not aware of the discrepancy and would be writing to the transport secretary for some answers on the subject.

I'm not sure how many MP's would be very helpful unless there is some political/private gain.
