He is not automatically responsible for repairs unless at fault. If they indicate a higher height limit then is actually true for vehicles passing through a vehicle lane then thats a fairly clear argument for poor design on their part.
Post a picture of the booth on the thread and we will give you the peoples judgement which will be a heck of a lot cheaper then anything involving lawyers0 -
if you really don't want the insurance to pay, let the insurance deal with the claim!.... then ask the insurance company how much to pay back the third party costs and change it to non fault + also not affect the NCD.
though i'd do this at renewal, and query what the difference is between a fault claim at renewal and non fault claim. is the difference bigger than the TP costs. if so, swallow your pride and accept the fault claim, you benefited.
you can pay the TP costs to insurance company back anytime (i can't see that being a problem) if it would cost the renewal premium more. (though beware of taking out new business quotations elsewhere and stating the facts correctly whichever way the claim goes)0 -
I would suggest reporting this to the local council authority, who would have responsibility for making sure ASDA complied with all relevant building and public safety regulations, so a transit van could pull in and pat for their fuel. The payment booth should be designed to deal with the range of normal vehicles that would visit the forecourt.
This should not a claim against the vans Insurance, but ASDA sorting out the defect to their premises.The comments I post are personal opinion. Send a photo of the sign with the hight indicator before they make changes.
If you vehicle was within the range would seem that ASDA would have to repair ur van0 -
Thanks for all your replies, this is just a quick note to say that I have now taken photos and will post as soon as I can, but the sign for the height is so tiny I found it difficult to find and I was looking for it, but the max height is 3m.0

I know what they must have done. They made a slanted lip overhead the counter for when it rains, when you lean out to hand back cash or cards, now you dont get wet but for anything taller then a car its also blocking part of the vehicle lane.
As well as the photo, it needs some measurements taken, a big ruler with spirit level would do the job. A video might prove better, its a hassle but then so is court0 -

Transit vans use petrol stations on a daily basis. In some ASDA petrol forecourts, you have to exit via a payment booth lane. The canopy of the payment booth should have had enough clearance stop it being hit.The comments I post are personal opinion.
