After contacting the ombudsman i wrote to Bank Smart asking them to uphold my claim against them, They wrote back saying that they are refusing to uphold it.
I have sent the letter over to the ombudsman and will await their decision, This is one dodgy company, DO NOT get involved with them0 -
A quick Google search reveals this company bring a new meaning to the words dodgy and untrustworthy.

FORMAL COMPLAINT AGAINST SYMMETRIC SYSTEMS LIMITED
Some time ago, you persuadedc me to allow you to let you look into the possibility of making a misselling claim on my behalf on a no win no fee basis.
Despite being unsuccessful, you have now sent me an invoice.
I put it to you that Symmetric Systems Limited knows that it is not entitled to such payment and has issued the invoice fraudulently.
Your fraudulent actions have caused me considerable distress and inconvenience until it was confirmed to me that, since you have dishonestly stated that I owe you money when you know it is not true in order to make a financial gain for yourselves is an offence under the Fraud Act 2006.
I require your Company Secretary, Ben Smart, to write to me personally, explaining why he has allowed you to attempt to defraud me.
I require Mr Smart to confirm that I owe Symmetric Systems Limited nothing and that no contract exists between us.
I require you to pay me £100 as compensation for the distress and inconvenience you have cause me.
I am sending a copy of this e-mail to your regulator and, should you not respond to my complaint in a manner that I consider satisfactory within 8 weeks, I shall also refer it to the Legal Ombudsman.0 -

Can anyone offer me any advice?
In July 2013, Lloyd tsb Got in touch with me stating that they may owe me compensation. from Ppi, I filled the former in and returned it. Not long after I received another letter which I thought was connected but later realised was from bank smart. I received a cheque from Lloyd in September 2013 and never thought anymore of it. I tried to cancel with banksmart in December after realising my mistake but after receiving a bill for over £700 ( for what I don't know and which we couldn't afford) decided that we would have to stay with them. I informed them at the time and on numerous occasions later that one of the claims had been upheld, at this point we were sent numerous forms relating to each ppi which we had to sign and return giving them permission to continue. I did not return the firm related to the above mentioned claim. I contacted them again recently after receiving an ombudsman form to fill in relating to the claim, they have now told me that we owe 25% +vat on the amount as we received it after we signed a contract with them and have pointed me to the ministry of justice. ? Can anyone tell me whether we do actually owe them this amount when the claim was instigated by Lloyd before this date and they didn't actually look into the claim until after the date we received the cheque.

If you are unhappy with them, I suggest you complain to them in the first instance - an e-mail to the above address will suffice but make sure you keep a copy.
If you do not receive an answer within 8 weeks - or receive one that is unsatisfactory before then, you can take the matter to the Legal Ombudsman.0 -
