Can she legally now have 2 different no claims?........

So is my RAC insurance actually invalid as I somehow inaccurately declared unkowingly that the the no claims is based on the main driver and not the policy holder?

Yes, having 2 separate NCD is no problem.

The problem you have, (I think), is that the RAC have mistakenly accepted the NCD, thinking it was for your wife.

This won't make the policy invalid, but if I'm right, and you draw it to their attention there may then be more premium to pay - as they may say you wrongly claimed the NCD was in fact your wife's!

Errors happen but usually when there is poor communication. This is the first time that I have heard of the main driver being given the no claims and not the policy holder. If it is a relatively new method then it would be advisable to make this clear in the process.

I still dont know how we are meant to know which companies do this during the process of using online comparisons.

Can no claims can be transferred from wife to husband?

Normally they do this in special circumstances (eg the husband has become a widower and is left with the family car they both drove/the wife has to stop driving for health reasons etc)

But in your case, they may have been under the impression your wife had the NCD in the first place and haven't transferrred it from you (RAC don't always ask for proof - was that the case here?)

    No proof requested.

About to try to speak to someone at RAC again.

Really dont know what the best solution is -

Use my renewal from previous year showing my no claims value (how long is no claims valid for?)

Change policy to wife using her 'new' no claims from RAC (is the renewal document with no claims value the only documentation which insurance companies check or is there are a database?)

When it comes to renew other car next month, change it to my name, but I will have zero no claims (as previously renewal states no claims is my wife's?)

RAC say that the no claims is interchangeable between husband and wife, so I should not have a problem. No claims is valid for up to 2 years.

I hope this will be the case when it comes to renew next week.

It isn't normally. Do they mean they will take either?

If you take out another policy with them, check carefully their requirements as I think they insist on the policyholder being the main driver.

I plan on taking out a new policy with a different insurer. My name as policy holder, wife as main driver. Send RAC renewal with no claims in wife's name.

So are you saying it is not legal to swap no claims between hsuband and wife, as this is what the RAC have just said? Is it only their policy?

I wish the insurance industry could make it clear.

It isn't "illegal", but I doubt another insurer will accept NCD in your wife's name on a new policy in your name!

Before you buy a new policy, ring your chosen insurer and tell them the NCD you propose using is in your wife's name, and if they agree, ask them to confirm this in writing before you buy.

This will preclude them being able to come back to you later saying the NCD is unnacceptable and wanting more premium.

So the info from RAC is not correct for other insurers?

Where is the regulation? Why can RAC be different to other insurers?

Did they tell you that other insurers will take RAC NCD proof as valid for a spouse to use?

Ask them to put that in writing! Then if (when) another insurer won't accept it, you will have grounds for a complaint which may reach the regulator!
