Could Three be choking my data usage?

I have a Three SIM only contract on a rolling monthly "One Plan" contract.
I supposedly have "All You Can Eat" data, which Three insist is truly unlimited, no fair usage etc etc.
Until about a fortnight ago, my download speeds were around 8-9mbps, with an upload speed of between 1-2mbps.
I've noticed over the past few weeks that my Internet is running at a snail's pace. After running a speed check, my upload speed is between 0.03 and 1.1 mbps. My upload speed is unchanged.
I have inserted a Three PAYG SIM into my phone, and am getting the 8-9mbps via that.
Three are adamant that they have not altered anything, and are blaming the reception/my phone/the weather/traffic etc, but couldn't quite explain why 2 SIM cards in the same phone, in the same spot yielded such different results.
I am a very heavy data user, which is why I opted for this specific tariff.

they did try throttling me once on the one plan, and i gave them a earful over the phone. I was getting pop up saying i was tethering which wasnt allowed on my plan!!!!!

Gave them an earful that i wasnt tethering and even if i was it was allowed on the oneplan. then the customer service chap said i was using my sim which was for phones in a tablet!!! They were labelling the samsung galaxy note as a tablet hence i was getting blocked as being flagged as phone sim being used in a tablet. Gave them another earful that same phone being sold as a phone by all other networks in the uk and world over. Then three didnt sell the phone but they later sold the phone on the network. More over before buying the phone i had mentione dto customer service that i would be using the note on my plan and was told ok.

But since giving them an earful i havent had the problem since.

Occassionally dont get data but guessing due to local mast problems but do wonder whether throttling.

I use anywhere between 10-20+ gb (the last few times i checked) or more as dont keep track now usually on my data usage without any tethering on my phone on one of my contracts but a lot less on another contract.

Contact them via twitter or blog about the issue. Twitter probably better as they cant delete your post but on the blog they can delete or not publish your post. But usually they do publish critical posts but sometimes dont. In the past the blog team have attempted to sort out customer service issues for me. But 333 is a joke most of the time, but on occassion have been good.

send them a subject data access request asking for all data held by three regarding your contract and specifically for all data about any data throttling for your number and say you will seek compensation for breach of contract. ask on the blog and on twitter where to send the subject data access request to, hopefully that should sort the situation. Atleast that is what i would do in your position.

    Wow. Thank you.
Surely this is unfair and in breach of the contract I have with them?

Will definitely give them a telling off. I won't hold my breath though. I raised a complaint a few weeks ago about them mucking up my bill, and despite being promised that my issue would be marked as urgent and that I would be contacted within 48 hours, I'm still waiting for my call back. :/ hmm.

he was sold a contract for the all you can eat one plan. He / she was entited to eat as much data as they want, a plan which they paid for.

You go to a buffet restaurant which serves unlimited food and get thrown out for eating too much the that would seem illegal. Same analogy applies here. They shouldnt sell something as all you can eat, if there are small prints saying its all you can nibble instead.

What he does with his data is nobody elses business as he is using what he paid for. You getting a decent connection is an issue between you and the network.

I too got throttled once for probably using about 5gb on my one plan about 6m ago, gave them an earful and told them i will hammer the data from now on and so i never switch to wifi at home now even though have an unlimited home connection too and i mainly use youtube tech videos or educational lectures etc but make it a point to view in highest quality. Now i guess i must be routinely crossing 20gb without tethering, i say guess as havent bothered to check recently. The last time i checked i had crossed 10gb in about ten days and 20gb the prev month. This month i seem to have used less at about 10gb, probably bexause i have used my laptop instead on home wifi and not used my phone that much. Some days i could cross 2gb a day or in a few hours.

I dont use netflix etc but even if i did. it still would be legal under the contract paid for by me ie the oneplan. I dont teher but even if i did it still would be legal under the oneplan contract.

I could hammer it on both my oneplan contracts but i have better things to do.

    A "greedy pig"?
    Seriously?
I usually just browse and watch about 5 hours of catch-up TV and whatnot, but due to my son's birthday and other family events, I batch uploaded some photos to Dropbox, which I assume is what got my data usage throttled.
Also, it's not my fault my usage slows up the network for other people. If a company is going to advertise to all of their customers that their data usage can hit 1000GB a month, they might want to make sure that they have the systems in place to keep it running.

I'm sure you'd be pretty peed off if you signed up for 3000 minutes a month, but after 30 minutes worth of calls you couldn't make calls for longer than 60 seconds at a time?

If my Internet usage is damaging your access to the service, don't blame me, blame the network who aren't supplying the goods they offered.

get a grip, the op is using what he has paid for. if the network cant cope, blame them.
