    yay, just had a dispatched email for the easel and hm armed forces tornado (really wanted the easel!!)

    my other 3 items are cancelled-pumpaloons, sonic screwdriver & megabloks dragon.

    went for store pick up, so will have to wait till tomorrow to see if theyre actually there.

    For those who wish to pursue on the basis that a contract has been formed:
    Tesco have not 'taken' the money, they have only 'held' the funds. Therefore no contract has been formed under the law.

    Trust me on this one, i've seen this many times before.

    As noted by others, Tesco have actually debited the money, rather than just held. However, even 'taking' the money does not necessarily stipulate a contract has been formed. For internet purchases, it's normally at dispatch. We also need to remember that terms must be both clear and fair, so what's written in the T&Cs is not necessarily legally binding.

    This is where is gets a little complicated with the Tesco T&Cs for two main reasons (see my post in this thread previously for the full terms I'm referring to):

    1) They state the initial email is not an Order Confirmation or acceptance, yet it is titled 'Order Confirmation', so it would imply this is acceptance.

    2) They state there is no acceptance until they notify you the order is available to collect in store, on the 'Order Confirmation', the date and time available to collect is stated.

    These are my interpretations, so a court may or may not agree with me, but it certainly gives you something to think about.

    the more fuss anyone makes about not getting their bargains, complaining to tesco, public bodies etc, the more likely it is that tesco will be to make sure in future that these super low prices don't even appear at all - surely we all still want these bargain prices to appear even if not all of us get to have them - if you didn't get what you ordered, never mind, it wasn't to be, please don't kick up a stink about it though as in the long run if you keep quiet and wait for the next bargain to pop up, you might just be lucky next time, but if enough people raise visibility of the bargains, then it's more likely there will be no tesco direct bargains at all for anyone in the future...

    just been to tesco's again and this time picked up toy story teller and fisher price giggle hammer..even though tracking not showing and no pick up emails

    i have just realised that below my dispatched order which totals £12 something, it also says still to be dispatched x3 Disney Princess Easel?????
    i only ordered the 1. tesco are making so many errors
