* need some urgent advice on being suspended for " POTENTIAL GROSS MISCONDUCT

Good Evening all

I work for a Large retail organisaon for over 5 years

we all signed a piece of paper regarding social network sites and using them

A person in work was treated quuite badl " in my opinion " they slagged of the company and they are in trouble.

I made a comment about there situation " I cant say what I said becasue they might know who I am on here

basically I havent mentioned the company directly in my reply or mentioned any namesdirectly but because I was directly responding to there post. I have been suspended pending a investagatory meeting

I would be grateful if any one qualified legally can inbox me and I can give you personally the low down on whats happened I am with my union in work and I am awaiting a leetter to attend the hearing / meeting about my comments

I look forward to hearing from someone shortly

    If your employer knows it is you and the company so will others so you need to practice groveling.

    Most likely GUILTY of stupidity from what ou have said.

    You don't ever link your place of work to yourself on the net except in the context of work like a CV or somewhere like linked in(even that is not acceptable to some workplaces)

    You read & signed the social media policy but ignored that warning & posted something which was work related - that was not a very clever move. It doesn't have to mention the company name if you're replying to someone who's peeved about work the chances are it WILL get back to the company. Due to you ignoring the policy on social media you have technically committed misconduct but it depends on the wording of that social media policy as to if it's considered gross misconduct - which i would suspect it would be. Hopefully the union can help you but ultimately i would expect for a best case scenario of groveling profusely to save your job.

    if there is "reasonable" reason as to you taking about the company and you signed their social networking policy then you may be in trouble.

    All depends on

    a) have you admitted your comments were about the company (even to friends/colleagues) as people in light of their own job security will blow the whistle.

    b) how ambiguous was it? Eg a) Fed up today, sick of dealing with Twonks - Prove that was work and not the contractor on your home - they'd have to give benefit of doubt as no proof either way.

    B) - you replied in someone else's update that you agreed (therefore inferring the company) then valid as reasonable assumption. By commenting on that thread/post/update it is reasonable to assume the comment was work related.

    So honest question - can it be traced back?

    I also stated in a another reply to my comments that the company were very helpful to me and couldnt do enough for me in my circumstances

    allthough I did reply directly in the thread I also replied again praising the company for what they did for me so I was replying in anger because they did not intially help this person as much as the help I received

    Then ultimately they can prove you breached their policy - how far they will take it if you aplogise and show that you also leapt to their defence will be up to them.

    From what you say (1 good v 1 bad) could just result in a warning Re their policy but I don't know their mindset. Grovelling if they proof of guilt is a good way forward!

    Sorry, I just truly do not get it. There seem to be quite a few posts similar to yours on here, and I am at a complete loss to understand why.

    I don't think there is a specific overall definition as such. Do you have a copy of your companies disciplinary procedure - if not you need to get hold of one. That will give you an idea of what they consider to be gross misconduct, but it won't be a complete list, it will probably instead give a list of examples that would fall within the definition, as a guide.
