    I have no problem with companies that cancel orders because of a mis-price, quite understandable.

    But to mess someone about and send them a dispatch email and then deny it has been sent etc.is very wrong imo.

    The law states does it not that once an item is dispatched the contract is made, to say the contracted is voided because a refund was made even though it was not requested can not be correct.

    It is my understanding that the OP could if they wanted, sue them
    in this instance for the difference in price. It has been done before by some on here if my memory serves me correctly.

    Nope, the law doesn't state that.

    The law states that until both parties explicitly accept the contract through wording to the effect or until goods or services have physically changed hands there is no contract and it is still a offer to treat.

    Remember, you have no contract with yodel, would it make any difference if the company themselves were the courier?


    It's all down to how the T&C state when acceptance has been concluded.

    You completely missed the point. Care to read. It's not about getting it or no. I said I don't care. They were well aware of such error at that time, you can read the Very & Woolworths representative post on that forum. Everyone got it in the end I think. They had enough time between the order date, 22.03 and the dispatch date 18.04 to cancel if they wanted.

    What I'm complaining about is the experience, what I have been through and the misleading information. The customer service and the email system is a joke. Each time I receive a different answer from different advisers for the same case. You shouldn't advise people to give up on their right and allow abuse.

    If you don't care about getting the wardrobe this should be in vents and highlighting the poor customer service which i agree could be a lot better. As for abuse, what abuse have you received?

    To also be mentioning principles when the item was obviously ordered from a typo and someones mistake seems a little rich to be honest. Even the post on hotukdeals mentions its probably a pricing error. Hotukdeals

    Yes I don’t care about getting the item itself as a matter of interest (you're still missing the point) but I care about my rights and fighting injustice. My principal is not to give up if you have a case and see injustice. For a proper definition of the word “abuse” please refer to any dictionary.

    You’re according to your comment judgmental and generic. You should start having your own brand.

    I’m here because injustice has been committed and sought advice.

    Melbell gratefully provided info and advised to speak to the Customer Excellence which I was not aware of. I don’t agree with his statement about the contract being null and voided though. According to their terms and conditions they are in contract.

    POPPYOSCAR also talks sense and logic and straight to the point. I thank them and others for the input and taking time to reply.

    I emailed them again yesterday. Now they are starting to realise and understand the situation and speak a bit of sense. They don’t talk about pricing error anymore. They agreed to price match. They consider it as a replacement. They order it for me at the present price of £369. I pay them £69, they send me a statement for the order at £369, £69 paid. Once item received I need to call them so they adjust my account accordingly. Price match once item received. Apparently that’s the only way in this situation as the system doesn’t allow them to order it for £69.

    It may irritate some but I declined the offer temporally till I speak to the Customer Excellence. I paid £69 and that’s the amount should be shown in the statement and I need a proper investigation into this matter. Once justice has been served then it’s up to me at that point to want the item or cancel it.

    So, you pay them £69 and they send the receipt stating you paid £369. After you've received the items they'll reissue the receipt/online account to show the correct price paid?


    And you're not happy with this?

    Sometimes I suspect customer services at companies is so poor because they spend so much time messing around with things like this! They've offered the item for the price you've paid and you're still not happy due the way it's going to be worded on the statement. Absolutely ridiculous

    If they're prepared to offer this in writing then I'd accept it. What more are you hoping to gain from referring tit to customer excellence.

    Don't be ridiculous. Of course a contract exists, and the company are in breach of contract.

    You cannot just rescind/void/cancel contracts for no good reasons, this would create an imbalance of fairness.

    Op could have a case against them if they refused to fulfill the contract. Whether it would be worth it is a different matter. Although such a significant pricing error could form a valid defense.
