    The point of fact and the law is clear on this, that they had a duty to inform me, and they didn't.

    The menu was in front of you (in a durable form). they are not required to tell you the price if it is displayed. (in the case, on the MENU)

    My [STRIKE]only[/STRIKE] mistake is [STRIKE]engaging further with your[/STRIKE] failing to ask the quetion about the Sunday menu, which I clearly observed on the table and this led to my poor understanding and grasp of the situation that on a bank holiday they advertise quite clearly that Sunday prices will be chargeable

    Why would I require a menu when I wanted that which was advertised outside, a Carvery. I think Azari has spelt this minor point out to you that you keep reiterating, very clearly, I thought you had that when you agreed they had made a clear entreat with the very large sign.

    Even you have posted that your local Restaurant sets out that Bank holidays are excepted on their outside sign, but that is not the case here, therefore it is unreasonable to expect me to read other signs to the contrary that are not as equally clear.

    And most are wrongfully assuming that their understanding is common place and that takes precedence over the law. I still fail to see why you'd rather I was wrong and they were right even when the law says otherwise. I made a valid point over tourists some posts back.
    This is becoming a pointless exercise, unless there are some constructive comments that are of help to the post or to others in future reading it, I see little point in perpetuating it.

    Ok how would this work under the "law"

    I walk past a shop with a large sign saying 50" plasma tv for £99.
    I go in, say i want to buy the tv.
    Sales asst brings tv out does the transaction on the till and says £599 please.
    I say, Im only paying £99 and if you want more you can contact me by post.
    I then try leaving the shop with MY tv and they threaten to call the police.
    In the shop there are a couple of largish signs saying £599 and on the TV on display it also says £599.
    I never bothered to look at them

    Turns out that price was a one day special (yesterday) and the signs still up.

    Still think your getting the telly for £99?

    The only ignorance is yours along with your attitude. If you spoke to the manager and waiter in the same way that you have replied/responded to posters on here I can only imagine what a scene you caused, embarrasing not only the party of friends you were with but likely upset other guests evening too, and no wonder you didnt get the expected result.

    Managers have discretion to refund/lower bills etc but like any one expect to be treated reasonably whilst doing their job if it gets to the stage where they are threatening to call the police you know you have gone too far

    Grown up people handle things much more diplomatically and sensibly, without causing big scenes and embarrasing their parties. We are talking what maybe £15 or so hardly worth a big scene and threat of the police....

    How easy would it have been to ask politely for the reason for the surcharge, ask where the signs were that showed this, ask why you werent told, if there were no signs, if no compromise was forthcoming on the bill, then pay and make a complaint through the correct channels, I am sure Toby would have been interested to know that their restaraunt was breaking rules/laws and would have been happy to compensate a refund and even vouchers for another meal for your party.

    Attitude, I think I have been reasonable throughout particularly in earlier postings.
    Your imagination is clearly working overtime, I can see no correlation between your observation and early posts.

    I did politely ask, where is the inference that I did not.

    This is all immaterial to the original posting and simply a regurgitation of opinion/ personalities over fact, law and substance, which is both tiresome, fruitless and unhelpful.
    I doubt TS would take the view they did if it was as clear to them, as those of you that feel it is to you.

    I have put in the local Toby outlets in my area into the search in my local area. It tells me that its over £9 for Sundays & Bank Holiday Mondays, with £5.95 for Jubilee Day.

    You really do need to learn about contract law as it relates to retailing.

    The answer to that question is so basic that I'm amazed anyone who's been on this site more than a couple of months doesn't know the answer.

    In any case, as I've explained TWICE, it's irrelevant in this instance because as soon as they accepted the order without making certain that the customer was aware of a variation from the initial invitation to treat then the contract was accepted on the initial terms offered.

    I really don't understand why you are having so much difficulty with this.

    Please go and do some research on contract law as it applies to retailing.

    As anyone who understand the law will know, there is only one acceptable outcome. They charge the the price that was offered in the original invitation to treat and which they did not ensure the customer knew was not the price they intended to charge.

    That's it. No compensation, just fulfil the contract as required by law.

    Why will you not go and learn about the law rather than making a fool of yourself by coming up with stupid scenarios that are irrelevant to the case?

    In your ridiculous example there would be no problem because the shop would never have accepted the contract at the £99 price. As soon as the sales assistant said, "that will be £599", the customer has been informed of the variation in terms and it is then up to them whether or not they wish to proceed with the contract on the newly understood terms.
