    Yes, he's gone. Presumably done on the basis of IP information. OK I was wrong and others were right. Will learn the lesson. But if he was fake it is the best one yet. Perhaps I should have stuck to my first gut instinct when I blew the whistle on his first post.

    Giving how touchy CAG are they may well have taken the post down because it was not verified. It probably is a genuine case, but the OP made statements that VCS/Excel may be held in contempt!

    As you cant call this business a scam on CAG or call a PPC anything derogatory, then it would not surprise me that they took the post down, until it's either verified or moderated.

  • Cheating and lying are what scammers do, unlike decent people who take others at face value. He will have taken some people in but the idea that a random law student, who seemed to know very little about the law, just happened onto this thread to pick an argument was very far fetched. I strongly suspect the individual was connected with the apparent VCS/Excel court hammering and was told to come on here and muddy the waters while the rest of that incompetent team ran around with deservedly red faces. We should know in a little while whether the case was genuine but at the moment there is no reason to suppose not.

    Even the BPA tells PPCs to stay off the site and not do the reputation of the industry further damage. But when you are as thick as some PPC operatives it would be difficult to get that message.

    To be fair he did have knowledge of the law. But the mystery was really why he ever appeared in the first place, I suppose. However, I would have said he definitely wasn't the same person as ppeterson or lawabiding. But if the forum team have access to IP info then it is strange that some of the reincarnations last as long as they do.

    Still, lets see if the original post is true because it is a major landmark if it is as reported.

    Just posted on CAG:-

    Before District Judge Mcllwaine sitting at S!!!!horpe county court, S!!!!horpe Court Centre, Laneham Street, Sc unthorpe, North Lincolnshire, DN15 6JY.

    Upon hearing the authorised officer of the Claimant company and the Defendant in person
    And upon the Claimant having issued proceedings in their own name

    And upon it being conceded that contrary to the British Parking Association Code of Practice contrary to same, the Claimant has no contractual authority to issue enforcement proceedings before the County Court either in the Claimants name as in this matter or the name of the land owner

    IT IS ORDERED THAT

    1) The claim is struck out.
    2) The order of District Judge Stephenson dated 3rd March 2012 is rescinded and the Claimant shall pay to the Defendant the s um of £42.50 w ithin 21 days of today.

    3) The managing director for the Claimant named as Mr Simon Renshaw Smith is ordered to file at Court by 4.00pm on 29th June 2012, a statement containing an explanation as to the manifest discrepancy namely the bringing of an action in contract and the tort of trespass in the companies name with no lawful contractual assignment of authority to do so.

    4) A copy of this order shall be served on the British Parking Association for information.
