Wheres Freddy Miles then to give his offical legal opinion....

    haha!

    P.s

If anyone fancies questioning excel about all this huff puff, their loss in the upper tier tribunal, and various articles you could always ring excel and choose extension 288 as this takes you straight through to litigation *chortle*

"A copy of this order shall be served on the British Parking Association for information."

Of course one of the leading lights of the BPA is Simon. Do I see a conflict of interest here?

Tri, perhaps no-one told the Judge that.

Are you reading, Peter? You are next, I think!
  • According to the Judge's order VCS/Excel have CONCEDED that they have no right to sue. The original report was spot on. No wonder that freddy was so worked up in his imaginary student lodgings.

As own goals go this one is momentous. Taken with the Upper tribunal decision it appears that VCS/Excel have just shot themselves and every other PPC in the foot. From my limited experience of them they largely pursue a very small number of claims against people they do not like or who have been rude to them, ie. a personal element, a very bad policy as these are the very kind of individuals who will fight back.

Maybe too soon to say the whole PPC scamdom house of cards is collapsing but it is certainly looking much shakier.

Keep up the good work VCS/Excel, with friends like you the PPCs do not need enemies.

I bet they feel like a naughty dog who has just done a woopsy on the carpet.

I wonder who will turn up next defending the PPC's

    Notts,

In the interests of fairness, I will defend them.

They are sadly misunderstood people who are only trying to ensure that the landowners do not have their land abused. I know this is true because Elvis told me so as he rode by on Shergar on his way to a drinking session with Lord Lucan and Santa.

    Or maybe not...

    Its not me, honest Guv.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

    Of course, it becomes arguable, that if Excel/VCS have been making demands for money to which they have conceded that they are not entitled; and have made those demands using menaces of sanctions which they cannot lawfully take;

then they have crossed over into the realm of the criminal law.

Be interested to hear the opinion of HO87 on this one. Will they be reported to the Police?

I would have thought that with this finding Excel should have their DVLA access cancelled. They are clearly not entitled to that information.
