  • Why have they been allowed to lie so many times and got away with it? If it was just a few times maybe yes but surely thousands of sick can't all be scroungers! Are so many of our consultants GP,s and surgeons so corrupt that they pretend they have operated on us,or stated we are unfit for work? We certainly couldn't pay them for this service! Even murderers are innocent until proven guilty.atos should be on trial not us!

An outcome you disagree with does not mean anyone has lied at any stage during the process.

Lying is a positive act, and few assessors will take against particular claimants, and actively mislead.

What is more common is simple pressure of work and carelessness.

This is almost as much a failing of the DWP as it is of ATOS - if you do not impose severe penalties in a contract for inaccuracy, you can pretty much expect it.

The problem is the beancounters are in charge.
    Penny wise, and pound foolish.
They give decisionmakers half an hour to assess each case, and don't encourage them to make the best decision they can. Just one that can be defended.
Each step of the process has been made the cheapest it can be, without regard to the effect on the overall budget.
Every little beurocrat is being rewarded for savings in their personal area.

I've read and understood the guidelines the assessors are supposed to assess people to.
I would have serious problems doing it, for the simple reason that the way the system has been implemented makes it very easy to make errors.

You are trying to (for example) work out if the person has any upper arm problems, so you're working on that section of the form, and trying to understand and accurately represent their ability in terms of descriptors.
During this, they happen to mention in passing another problem.
But you're not at that section yet, and so you try to remember it to ask it later.
You get to that section, and you confuse this guy with the guy before, and ask questions about a disease they don't have, and so miss the original question.

This generates a report that looks very much like you're lying, but is entirely malice free.

It's simply a broken system with inadequate checks, that is pushing the assessments to happen in unrealistic times, and not following up adequately on errors.

There is plenty of blame to throw around here - none of parliament, the DWP, the tribunals service, ATOS or even the postal opening centres get out of it looking very good.

It's a system with inadequate checks and balances.
If the ATOS assessors were civil servants, or any other company, with the same timescales, and targets, you'd get pretty much the same results.

They are overworked people, inadequately resourced, in a system that does not have adequate feedback to say 'this isn't working, we need to change it'.

As another example of the systematic failures.
The decisionmakers get a pack, including a report from ATOS, your forms, and all other evidence.
They have half an hour to decide on this - which means they can't really easily be phoning up people, or chasing for evidence that may seem like it may be useful.
Their sole goal is understanding the pack, and making a 'reasonable' decision.

There is no independent quality monitoring of DMs.
For example, a simple check might be to have a random sample of 5% of cases a DM checks checked by other DMs, to see if they come up with a different outcome. (without knowing the original result)

    This is never done.
They do check a certain percentage of the cases, but only to see if the DM has come to a decision that is completely irrational, and can't be argued from the pack in front of them.

This is a very different thing.

Speaking personally, ATOSs performance of their assigned tasks has been the most efficient of the bodies involved in my case - the DWP, ATOS, the tribunal service.
  • Sorry Roger but the HCP told blatent lies in my report.
  • Too many lies and twisting the truth by missing out half the conversation! Asked how he got to medical husband said he drove himself against advise from surgeon and was in agony on journey but when asked how he could get there was told they would let him know.their advise was so helpful ,walk to bus stop,30 mins,6 changes of bus, walking between stops.took 3 hours when car takes 35 mins.not helpful if every step is agony! In her report said drove himself to medical, guess she didn't have time to include the rest! No points no points! No points! No limited capability even if you are on operating table having spinal surgery.even if it was day after assessment. Maybe should have to take lie detector to prove we tell truth be more reliable!
  • Sorry Roger but the HCP told blatent lies in my report.

Dont worry, if theyve lied then simply get a copy of the report and point out those lies with evidence

  • On my Atos medical it said I drove, when in fact I told her I didnt anymore, due to sleep apnoea. Plus is it said I sat in the chair for 45 mins, then contradicted it by saying I got up 3 times & it said I'm a bloke. Very observant.

  • That sir, is brilliant

But I suspect Mr Black will have an excuse for it

  • Oh well, Another form and letter has come through the post just over 2 months after the last medical, Looks like another 2 months of stress i just hope i get through this. The good thing is Welfare rights are coming out to fill the form in for me thats one less stress for me to deal with.
