OK, bit of an idea - might not work, but might be worth a try.
Can you contact your ex via his work?
If so, in order to get ex to sign over his rights to mortgage - you need to draft up a letter that he would sign agreeing to signing over the mortgage.
Then send it, complete with an SAE addressed to the bank registered to his work address. Add a covering note to ask him to sign the attached and post to the bank.
Alternatively, send it to your address so it is redirected.
Worth a try?

£160 is monthly and my oldest sons dad is paying maint for him.I went on entitledto.com(or someting like that) and put in my details and it did not come up with the thing that said I was entitled to help with council tax so will prob have to much coming in to get help with mortgage!!

My understanding about council tax relief is that it is not means tested but it is based on a number of things including single person (adult) occupancy.
This should mean that you can reduce the amount of council tax you are paying - give the council tax dept a call tomorrow, in my experience they are fairly quick to make the necessary adjustments for things.

They reduce by 25% if there is only one adult in the property. My advise would be to write everything down so you know exactly what you have coming in and going out, this will give you a sense of organisation and being more in control anyway. Ensure all companies that your ex owes money to are aware of his new address and write to all others and let them know your predicament - the sooner, the better - they should be understanding.

My mate was telling about a friend of his wifes, whos husband walked out on them, and left her to pay the mortgage, (they've got 2 sons).
She went to a solicitor, and apparently, the solicitor told her that he cannot force her to sell the house for 5 years!!! Now whether this is true or not, I dont know. If your solicitor has told you he cannot force you to sell the home, and would TRY and not to worry about it (I know it will be hard).
Keep your heard high, and fight him all the way, remember, hes the one who walked out on you and your littles ones, hes the one in the wrong not you.

feeling really low today!! youngest son is seeing his Dad and Girlfriend.So will be seeing her in the flesh today.was hoping for his ddad to see him on his own but he said that as he is having him for a few hrs he will take him to his home,the one he shares with his girlfriend.Still havve not sorted out anything since last post.ex is refusing to sign mortgage to interest only.have got a payment break til june 1st so some time but I hate not having things sorted out,its making me feel so low and am crying a lot more.Just cant see an end to things at mo

Big hug to you. Things will get sorted out even though at the minute there seems no hope.
Think of your two lovely children and keep focused on them. Even if everything else is horrible at the mo you will always have them and they are worth more than any house or money in the world.
I used to work in a legal office (until I gave up to have our 3 year old) and the solicitor is right - he cannot make you sell the house and he cannot just go ahead and sell the house if it is joint names so although it is easy to say try not to worry about being homeless.
Keep thinking that if he can do this to you and his kiddie then you really are better off without him.
Theres nothing wrong with having a rant and a cry - we are all here for you and things will work out.
