    Can it get any worse!!!!!!!phoned up the mortgage company to ask about after my payment break changing to interest only and they said I need my ex signature. I have no hope of getting that so am panicking now.if i cant change the mortgage It will revert to repayment after the payment break and I cant afford it.I know my ex wants me out so he wont be bothered and the solicitor keeps saying things take time, which is not a lot of help at mo.I just feel like telling my ex he can have the bloomin lot I dont know how much more I can take

    no I am not paying the 2 big loans, but as they are in his name he has redirected all his mail and i dont know where he is living as he wont tell me.
  • Hi Jules. Sorry to hear about all your troubles, I hope things can financially sort themselves out for you soon, and you get through it all. I also hope the following makes some sense:
    My husband's ex wife had the mortgage on her house paid for by benefits (it was interest only). She was working part time whilst this was being done. It is possible that you would be entitled to get the interest bit of your mortgage paid (although not the repayment bit),as when she initially got the house and had not changed the mortgage to interest only, she still had it paid (just had to pay the repayment bit herself).
    I know it's not all of your mortgage, but if this were possible then it might be a help still?

    Jules, you are in a hard and stressful place just now so hugs to you.

    I would like to advise as other posters go to the csa asap as his liablity does not start until they contact him, which they should do within 28 days of receiving your claim for. Do get the money via them. Mine takes 8 -10 days longer this way, but there is instant proof of missed or under payments. For one child you are entitled to 15% of his net income.

    Chase of tax credits too. If you work 16 hours or more per week you need to get them reassessed.

    If you are going to court you will need a very clear soa like the ones posted on here. If you post yours here you will get some good advice. Remember you will need to include any cm for your 10 year old.

    If the mortgage is joint it is his liablity too. You should not be paying it all just now unless he is giving you money to do so. I know this is a hard one because if you don't pay you face being homeless and having a bad fiancial record.

    I have just typed all of this and realised there is another page to the thread, sorry if I am repeating what others have said.

    my ex has started to pay £160 for his son so should i still go to the csa? He pays his 1st ex maint for his other 2 kids so the money i get compared to what she gets is good.i have got tax credits sorted.It is just theissue of the mortgage.My solicitor has written to my ex on more than one occassion about money for the mortgage but he is not forthcoming with any and i have told the mortgage company and all they say is that it has to be paid they cant comment on any family situation

    To give you an idea of what he should pay calculate 25% of his take home pay. Divide it by 3 (as your child is entitled to 1/3 of this amount). If £160 is more than this then you would be better not going via the csa. If you are confident that he will continue paying. Whether he is reliable about paying for his other children should give you a good guide.

    The mortgage is tricky. You are recieving money from him which is meant to cover things like his share of keeping a roof over his child's head. I think you ought to check this out with your solicitor. His solicitor will naturally argue you should pay your share and that the father of your other child should also be contributing cm into the equation as that child is living in the house.


    Is the £160 monthly? You tax credits do not go down because of cm. As long as you work the cm wont be taken into account for tax credits, although may effect other means tested thinsg like help with mortgage interest and council tax. I don't get help with these so not sure. I do know it doesn't effect tax credits.

    As far as I'm aware he has to pay 15% of his net income for the upkeep of the 3 yr old as does the father of the 10 yr if you go the CSA route.
    (Its different if they have fathered children elsewhere)

    £160 is monthly and my oldest sons dad is paying maint for him.I went on entitledto.com(or someting like that) and put in my details and it did not come up with the thing that said I was entitled to help with council tax so will prob have to much coming in to get help with mortgage!!
