Do you have anything in writing to say that she owned the car from new? It dosn't exactly stipulate it in the advert that you have posted. I would agree that the seller has 'pulled the wool over eyes' by the sound of it. Never heard of anyone picking their car up after an MOT without the certificate. Unfortunately, the SOGA only applies to purchases from a trader. There is usually only 2 avenues to persue with a private seller which is if the car is theirs to sell or they have made false representations about the car. It seems that the latter may apply but you would need to prove it.

Another thing is to make sure that they were in fact private sellers by checking that their info marries up with the V5 and that they aren't selling other cars.

Edit; I also just spotted the 'one lady owner' bit. Changes things considerably. Yes, you can pursue for miss-advertising. I assume you have a copy of the AD?

No they are not dealers, they are lawyers.

    private or trade sale?
its a 7 year old car
did you expect it to require no work ever?
V5 should have been checked pre purchase

If the MOT was present I would have negotiated a lower price to reflect the price of replacing the discs.

    Presumably no HPI check?

As for the number of owners shown on a V5C::
Original registration to the Lady - keeper No 1.
The Lady changes to a private plate - keeper No 2.
The Lady puts original plate back on - keeper No 3.

My son bought a car privately last Friday with the V5C showing 6 previous keepers but the HPI showed 3 plate changes so physically the seller was the 4th keeper and not the 7th.

I don't really understand the issue. On a 7 year old car does the number of owners really make that much of a difference? As for MX5's you always buy on condition, presumably you could see the brake discs yourself when you bought the car and could have checked the MOT online should you have been so inclined and could also have checked the number of owners online. It doesn't sound like you've been conned to me, just slightly naive.

Have you checked the sills, rear wheel arches and boot for rust, that's the biggest issue for MX5's. Make sure you clear the drain holes for the roof asap to make sure they're not blocked, as it's that that is the main cause of rust on MX5's. A set of rear discs will set you back £50 and are a service item so not really a big issue.

Where are you based, I might be able to recommend a good MX5 specialist close to you. If not, get yourself on MX5nutz.com or mx5oc.co.uk for some friendly help.

The V5 document has just come back from DVLA and it says that there were three previous owners. We were told by the wifes husband that she had owned the car from new,
If you had checked the V5 when you were looking at the car you'd have seen two previous keepers...
also the MOT was not present and would be sent on to us as the garage had forgotten to leave it in the car. When the MOT arrived it was issued with advisory warnings regarding front and rear discs. They are both pitted and need replacing at considerable cost
It has an MOT. That was an advisory and one typically handed out by garages touting for work not needed. I have yet to see a brake disc that is pitted to MOT fail. On a car being driven it simply doesn't occur. If there is any, it will disappear in normal use. Ignore it.
Do I have any form of redress I can take or have I been shafted.Any help would be appreciated.:(
No recourse. Caveat Emptor. All the information was there when you were looking at the car. You can see the brake discs yourself. You can look at the V5 and see the number of previous keepers on it before you buy the car.

    Tax/MOT October 2012
MOT is six months old. Get the disks checked or wait for the next MOT.
You could speak to the garages who did the early services. They may have payment details to show possible owners. Would the extra owners make a difference to the value?

This was the advert for a car that we have just purchased.

2005 55 Reg Mazda MX-5 2.0i 2dr ConvertibleOne lady owner, Full Mazda service history, Always garaged, Remote central locking, Alarm and Immobiliser, Electric windows, Electric mirrors, CD player, Driver and passenger airbags, Wind deflector, Tax/MOT October 2012, Immaculate condition, Very reluctant sale.£5,999

The V5 document has just come back from DVLA and it says that there were three previous owners. We were told by the wifes husband that she had owned the car from new, also the MOT was not present and would be sent on to us as the garage had forgotten to leave it in the car. When the MOT arrived it was issued with advisory warnings regarding front and rear discs. They are both pitted and need replacing at considerable cost, hardly immaculate then.Do I have any form of redress I can take or have I been shafted.Any help would be appreciated.:(
No they are not dealers, they are lawyers.

So you researched the sellers occupations but missed the obvious, a simple glance at the V5 to verify facts about the car itself?

You also bought the car without sight of a valid MOT (or checked online for the current validity)

And you bought a car privately without an independent inspection by the AA/RAC, etc

    D'oh!

    Who are the previous owners?

    Mommy, Daddy, Daughter?

The brakes may well be completely fine, my brakes had MOT advisories for 3 years in a row, got them changed last Nov and the mechanic (trusted) told me they still had a good year left on em.

Tyres are a good measure of a genuine car, if the owner skimps with cheap tyre's, the car probably hasn't been looked after too well.
