I proceeded with court action against hsbc on the 21/02/2007, havent heard anything until this morning and that was a letter from their solicitor requesting a break down sheet of all charges i am claiming. they now have until the 27/03/07 to make their defence. How long do i legally have to forward this requested information to their solicitor? should i send it today or wait till the 26th to give them the smallest time possible to prepare their so-called defence?
You've probably already sent it, but send it again to the solicitors. It's probably better not to stoop to the same stalling tactics. It's unlikely to be in your interest if you want this resolved ASAP.0 -
Hiya,
I hope someone can help me. I have been through the process with HSBC and am currently taking legal action, there is only one week left for HSBC to file their defence before I request judgement.
This morning I got a letter from solicitors acting on their behalf requesting a breakdown of all the money I was claiming including the charge, description of the charge and a note of any interest I am claiming. I have already detailed all of this to HSBC in previous letters and have detailed it in the claim I have made with MCOL. Do I have to provide it again for their solicitors ? Is it not up to HSBC to make all of the information available to their own solicitors ?
Any help would be very, very much appreciated !

They probably have it, but it's probably in your interest just to send it again anyway.0 -

Sneaking in here with a little tip. Fax the solicitors the details. The number should be on their letter, ring them if it isnt for it. The Post Office will fax things for a small fee and their receipt is instantaneous so no delays.
*sneaks out again*0 -
OK thanks very much, I have a fax at home some will get the information over to them this afternoon.
I thought that it was the responsibility of HSBC to provide all of this information, but I do have it to hand.
Thanks again,

I'm taking HSBC to court for ₤540 and I got a letter from HSBC solicitors yesterday demanding a breakdown of the list of charges - which I sent to HSBC in January!!! ps. The court date is set for 30 May. Does the fact that HSBC solicitors are contacting me direct indicate they are planning to go all the way to court?0

Hi Engine, just send the list of charges off to the solicitors. Do you have to prepare anything for your court date ? Is it the full hearing or a direction/allocation/case management/prelim hearing ??LegalBeagles0

sounds to me like hsbc's solicitors have just sent out a large bulk of the same letter to everyone so probably not interested in the individual cases just trying one last ditch attempt to scare people into not continuing with their claim before their defence deadline0

Hello to all the brave souls !
In the process of taking the A&L to court for my partner (I shall be taking Lloyds to the same place in 3 days !). Sent my original request for refund in mid Feb which included all charges from Feb 01 to Feb 07. As my application to the Court was in March the Solicitor's letter from the bank says that i cannot request money over six years. As my original request for a refund was in Feb can I still ask that they refund these charges or do I reduce the amount entered via Moneyclaim ? The Solicitor at A&L is also asking for a breakdown of charges. Do I refer them to my previous letters or fax a new breakdown showing a reduced amount? Phew !
Any light would guide my way nicely !0 -
Hello,
I have started proceedings against HSBC for the sum of £1785.50. I have download both of the letters and had the standard reply of we will be looking into the matter and reply within 21 days. I thought no you won't and have started court proceedings against them.
My case has been refereed to my local County Court to which I have just sent of the questionnaire and fee.
I did receive a letter from HSBC's solicitor asking for full details of the fees, dates, costs and description of the charges. I have unfortunately lost or thrown this letter out. But my questions is should I have replied to it??
I guess the bank is trying to get out of a few payments because they now call it an overdraft arrangement fee. I received a letter today from HSBC saying that my informal overdraft has been approved to which a fee is payable. But I'm guessing an arrangement fee is the same as a default charge just a jazzed up word for it.
But only today did I manage to obtain proof that the fee is for going above and beyond my overdraft limit. I do not wish to disclose this information here until a later date.
I'm now I guess awaiting a court date. Any tips or advice please.Helping the country to sleep better....ZZZzzzzzzz0
