Letter from bank/solicitor during Moneyclaim online process...

    As you can see by the above posts generally its recommended to just send off or fax the solicitor the list of charges even if they already have this information. Basically now though you just wait to see what happens next.

    Interesting that HSBC is asking for all the information once again. Surely a company of that size can copy paper work and head it in the right direction?

  • I really need some advice. I filed a small claim against HSBC having detailed all of my charges from my bank statements. They acknowledged and they have filed a defence. At the same time their solicitors wrote to me asking for details of all of the charges I'm claiming for. I went through all of my statements again to cross reference against my spreadsheet before sending the details to them and I can't find 2 of the charges in my statements! I know what they're for but the dates don't seem to match and I can't find any others they could be for!!

    What do I do? Should I just leave them in anyway?

    Debt now (15/06/07) - £83,908.47 (still :eek: but every little helps!)
    Debtfree Date - 2015 (but working on it)!

    Just leave them in as the solicitors should already have these details from the bank.
  • Thanks. I'm just really worried now that I've made a mistake and that's why they've asked for details of the charges because they know the amounts don't match up. I don't understand why else they would ask.

    I'll pop this into another thread where you'll find its becoming quite normal for the solicitors to request this information and although they already have it just send it or fax it off to them to keep them happy :)

    my partner and recently went throug all that martin said on the website and are now in the court process....
    abbey are defending the claim as we recieved a copy of their defence via the court.today i recieved a letter personally from abbey themselves reading.....

    dear....

    we are in the process of reviewing this claim and preparing our response.a defence will be filed in due course.

    in the meantime,we note that you have claimed the sum of £809.82 in respect of charges that you say have been made on your abbey ccount.we appreciate that you may have previously forwarde details of your claim to our internal complaints department however,we do not have access to that information.to expedite the processing of your claim would you therefore please provide to us.....

    1. details of how you have calculated your claim by date and amount of each charge claimed..and..

    2. details of how the interest is calculated,showing how interest is calculated by reference to each charge.

    as you will appreciate,you will need to produce evidence to the court regarding these amounts and this information should have been appended to your claim form when you filed your claim.we should therefore be grateful if you would provide us such details to us as soon as possible.

    it would also be helpful at this stage if you can provide email and telephone contact details to us....

    I got exactly the same letter so it is obviously a standard ploy on the bank's behalf. I also got a letter the previous day from customer services offering about half of what I had claimed back.

    Like you I am a bit confused. It appears that the left hand of the bank doesn't know or care what the right hand is doing. For a large bank with all its technology not to be able to find out the bank account number and the charges claimed for seems a bit daft so I think this is possibly just trying to be difficult an dput people off carrying on going to court.

    I don't know the answer to what is the best response but I'm am sorely tempted to just reply and say to the bank - 'find it out yourself'.

    Like you, I'd llike some tips as to how to deal with this development

    I would send them what they've asked for because you are at court stage and could lose by some technicality due to information requested not forwarded etc.
  • Hi I am at Martin's Stage 4 with Alliance & Leicester. I have made my claim via Moneyclaim website and A&L have sent copy of their defence. Presume it is pretty standard - charges are not a penalty, dispute interest charges and they state my claim is greater than 6 years.

    Their in house solicitor is asking for a breakdown of charges since 14th March 2001 (6 years before the day of my claim on Moneyclaim) within 7 days.

    1. They already have all the charges provided on Martin's Interest Calculator spreadsheet. However this covers the period Dec2000 - Dec 2006 as I started the process in Dec 2006. Do I really have to adjust the claim to these dates and will it affect what I have filed on Moneyclaim?

    2. Should I give the in house solicitor a response or simply refer him/her to previously provided info?? :confused:
