Send it back, get it cancelled and start again. It's not worth the risk of this rumbling on an on, even if they send you the right sim you may then find you end up with two active contracts going on and on. If you like the phone great, get the same model again.

You WILL almost certainly be credit checked again, theres no easy way around it, the check will be done by the network automatically as part of the application. Most likely Tmobile rejected you as you've just had a check done (either by TM, mobiles.co.uk or o2) and applying for too many phones too quickly throws up flags.

However if your getting stressed by this you need to let it go and send it back.. You've tried to get is resolved and not got anywhere,

If you think this is stressfull then don't even consider court, use the DSR to your advantage and cancel the lot and try later as OneADay suggests.

They have spoken to O2 and confirmed that nothing has been set up with O2.

Do you think I have some grounds for sueing them? Smalls Claims court?

What would you be sueing for? How could you calculate any posible cost to you?

If you have applied for a mortgage and as a result of this get refused or special terms imposed, and you have evidence that this is directly responsible you have a case.

If you haven't applied to anyone yet (as you imply) and get a ho hum deal could you ever point to this as the case? The market at the moment is not exactly awash with great mortgage deals, lenders can impose these so-so deals as they know the mortgage market isn't bouyant. Proving this event is the reason you get a so-so deal as opposed to current market forces could be almost impossible.

Hi - It was ordered with them via t-mobile and no mention of O2, the thing is I have the phone and like it. I have an email confirming its with t-mobile.

No one will give me a new contract as they've ruined my credit rating!

Do you know that T-Mobile actually did an equifax credit check?

I'm having issues at the moment getting a T-Mobile deal approved through either of the discount resellers buymobiles, or mobiles.co.uk.

To cut a long story short I now have a pre-approved credit agreement no. from T-mobile.. but I got rejected by them again through mobiles.co.uk.

After many calls and store visits, the bottom line is that T-Mobile are perfectly happy to give me the same tariff if I go direct with them (at full price), but on the same tariff through a 3rd party I fail their credit check.. for undisclosed reasons.

I know for a fact that they haven't done a check with equifax - I receive alerts from them when anyone searches my file.

Looks like they're simply not encouraging the use of discount providers by making life difficult / impossible.. which is what their store manager pretty much implied today.

The credit check do not ruin your credit history. A lot of companies Do credit check. Not getting the t mobile is for other reason.
The bank is not going to stop the mortgage because O2 have done a credit check.

    Who said 'history'?
The OP said 'ruined ... credit rating'.
Multiple searches in a row do damage credit rating for a short term. Fact.

Log in online to your mobiles account, if that says it is an O2 contract, unless you've got evidence to the contrary (emails, screenshots etc) then you either keep it or send it back.

Can't see why T-Mob would refuse so soon, but i doubt it is cos of the O2 check as they don't update the Credit Reference Agencies that quickly

But multiple inquiries can also result from loan or credit applicants shopping for the best deal.
I think the credit to income number is lot more important.

Then it would not be a problem surely?

Searches on Credit Reports can and often do have an adverse effect.

One or two search by tmobile and o2 is not going to stop you getting mortgage and other credit. The bank is more interested in your income vs all other credit you have. This show them if you are able to pay or not
