mobiles.co.uk t-mobile are slowly destroying me. Can anyone help?

I have just sent this letter to mobiles.co.uk (CarphoneWarehouse) and T-Mobile.

I am REALLY REALLY angry about this!

Dear mobiles.co.uk/CPW/T-Mobile

On Friday the 13th April, I found the deal for my HTX One X with mobiles.co.uk and placed an online order.

On Saturday 14th April I received the phone, I was very happy with the speedy service. Now I was to discover that the problems would start and things would become awful for me.

Today at mobiles.co.uk I have spoken to Ol, Li and Ma. I have also spoken with several people at T-Mobile and the most recent was Je on 0800 956 xxxx.

In total I have spent over 4 hours on the phone and haven’t really got anywhere.

My issue:

The package I signed up for was with T-Mobile but I was sent an O2 sim card.

Today I have spoken about this and something happened whereby I was credit checked again and refused by T-mobile.

mobiles.co.uk - you say you cant raise a sim card for me with a phone number without doing another credit check, a check will fail as this debacle is destroying my credit rating

T-mobile - you have advised that my credit rating that was carried out on 13th April 2012, credit was good and I am allowed up to 2 phone lines on this account- *the credit check account number is 13xxxxx70 and its still open for credit for a few days only.

The number I have already been given with the phone is an O2 number and the SIM is also O2 - Why was I given this?

There is a note on the invoice that reads (see attachment) 'do not send set up with wrong sim card' I am guessing this maybe isnt the first time its happened, how was this overlooked?

By reapplying for SIM cards and credit is actually damaging and damaged my credit score - I am very distressed by this especially as I am about to apply for a mortgage as we need a bigger house due to the arrival of our new baby boy. Until now, I have never been refused credit nor had any credit issues.

I am emotionally drained by all of this, what I thought was going to be a nice new phone and move from Vodafone to T-Mobile has fast become a nightmare and I haven’t done anything wrong, yet I feel like the victim.

PLEASE do NOT credit check me again unless you are 100% certain it will be accepted.

From what I gather, I just need a T-mobile sim card, that’s it.

I would ask kindly that you all please talk to one another and please just put right was has gone so horribly wrong. I just can’t put into words how frustrated and upset I am by all of this.

    Was the order confirmed as being with T-mobile ? i.e. did you get the email confirmation before receiving phone?

    It looks like you have ended up with O2 contract rather than the T-mobile one you wanted somehow - personally I would return the phone within the 14 day period you have and re-order later if you still have strength left.

    Hi - It was ordered with them via t-mobile and no mention of O2, the thing is I have the phone and like it. I have an email confirming its with t-mobile.

    No one will give me a new contract as they've ruined my credit rating!

    If you are sure about this, then get some legal advice on sueing them for the damage this will do you.

    It could still be the contract is with O2 through their error - do t-mobile acknowledge they have you on contract with them.

    If you ring 202 on the mobile you will probably get to O2 customer services with the O2 sim card - in which case its a contract with O2.

    I would still attempt to send it back and get it cancelled rather than worry yourself. Returning phones is never too easy - best to action it quicker rather than later.

    They have spoken to O2 and confirmed that nothing has been set up with O2.

    Do you think I have some grounds for sueing them? Smalls Claims court?

    t-mobile know I have been credit checked but an account isn't actually open as mobiles.co.uk haven't set one up or generated a mobile number for me!

    I thought of doing that but scared they will try and say I am now stuck with an O2 package or something. The O2 sim is still in its case all intact.

    Yes, if they have "ruined" your credit rating as you say.

    You would need to be able to show their action has/will prevent you from getting credit/mortgage etc.

    As posted, if you are sure about this, get some legal advice.

    Keep O2 sim it intact - as you soon as you use it, it will be come acceptance of contract. Presumably you have used some existing sim with the phone?

    In any case, you can complain about your credit history on one hand but don't forget you only get 14 days to return the item or else you might get lumbered with a contract you did not ask for. I would do a return and ask for compensation for messing you around and the phone call costs.

    And on plus side, you might find a cheaper deal after returning it.

    On T-mobile, they are raising their tariff from 9th May too - not sure how that works when you have only got contract just 3 weeks before the rise. Its something to consider.

    NO, I havent put any sim in the phone at all, its a micro sim and i dont have one of those. Do you mean tmobile will increase the price or the minutes etc?
