Many thanks for the very informative post. I have a question regarding the paragraph you wrote about damages.
Can you tell me why a PPC cannot claim for time spent chasing the debt please. It stands to reason that a parking attentant is paid to patrol the car park anyway but what about the back office staff that potentially spend an hour or so?
I would have thought that the same principle applied but would greatly appreciate your professional opinion on this.

For my part, I would point out that if you are trying to collect something which from the start is not collectable by law then you can hardly raise a charge for doing so! There may be a case for adding something where there is plainly a valid claim- such as a failure to pay a proper parking charge- but, where the intention is to try and impose an unlawful contractual penalty (100% of PPC cases) then if the penalty isn't lawful you can't charge to try and enforce it. If you think about it, it would be an absurdity if you could.

I know I have no right to do that, but as it has taken me time to think about and send you this notice, and you will also receive some letters demanding the money, that means I am now perfectly entitled to insist you pay and I know the County Court Judge will back me up".

One might reasonably argue that the number and cost of your back office staff was a function of the inadequacy and inefficiency of your parking attendant in failing to deter all of those breaches of contract/trespass he was having to issue tickets for. I mean that is what he's there for, isn't it? After all, there is a general principle, in respect of damages, that one must look to minimise one's losses as far as possible. And how many PPC-operated car parks actually have a full-time parking attendant at them? And if there isn't one there full-time how can the area be managed?My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

Was it the BPA who tried and claim that the amounts charged were justified as they included set-up costs for the car-park and other fixed costs the PPC would have paid out anyway?
How many Parking Pie operated car-parks actually have someone whom walks around checking instead of just using a dodgy CCTV system to flag up any vehicles staying longer than they should?0 -
I have also been victim to these robbing !!!!!!!s i use a carpark in st st ives just around the back of the co-op down the side of a laundrette just yesterday 24/4/2012 i payed and displyed my ticket for 3 hrs we normally take the dog to the beech for an hour with are son then leave the dog in the car for an hour or so while we hit the shops on returning to the car approx an hr later to fined i had a parking fine now the thing is it was a warm day so i left the windows open so the car wouldnt be warm when i came back with the dog and found my ticket had blown off the dashboard and down the foot well i rang the number on the fine to explain that the situation only to find them not very helpfull also said how do we know its you who purchesed the ticket and didnt get off someone else!!! To witch i replyed you have cctv on the carpark that you can check but didnt want to know!!! I also asked why they wernt carpark tickets with a sticky piece of paper to stick to the window
Then i rang again the next day to find out if they had an office in penzanze that i could come to to try and resolve the situation with them all he said was you have 7 days to pay or appeal the fine then i said im from bolton and would rather resove the situation whilst im down here he then said it doesnt take bloody 7 days to get back to bolton does it to witch i replyed no but im down here for another 4 days and havent got a checkbook with me he then said i spoke to you yesterday stop wasting my BLOODY time n pay the fine!!! Wouldnt listen said its my own fault for leavin the BLOODY window open for my dog

SO IF ANYONE HAS/WANTS TO CONTACT ME WITH ADVICE ON WHAT TO DO PLEASE COMMENT A REPLY and why is the fine so high at £50 because its only £30 where i come from these dicks are nothing but a bunch of criminals ive got a good mind not to pay the fine as ive still got the ticket and sent them a copy of it also surelly if i have evidence of purchase no court in the land will settle in there favour??0 -
Long story, short answer. Stop trying to reason with scamming idiots who won't listen to a word you say.
Keep your pay and display ticket safe, and from here on have NO FURTHER COMMUNICATION with them at all.
Don't phone, don't write. Leave the !!!!!! heads talking to themselves. You will get a few asinine threatening letters after which they realise you weren't the mug they took you for and give up and GO AWAY.
You owe them NOTHING. So that is what you pay them. They are crooks.0 -
