  • For the sake of £1400 would it not have been better to cut your losses than fork out loads of money to just get the original amount back??? Seems like a waste of time to me personally unless you'd be getting your court charges back as well. :confused:

    The court charges are added on top - the figure that has been put on his property is nearer £2000. Like I said above it is the principal now, but even so £1400 is a hell of a lot of money!!!!!

    Furthermore there are many options to recover a debt - you have a CCJ against him.. You say you couldnt find bailiffs to collect... what are you talking about..? The county court bailiffs go out to enforce unpaid CCJ's - you dont just phone someone out of yellow pages..

    And you say you are going for a CO, yet no nothing of how these work... thinking you can only get your money when he dies or the house is sold.. You havent read up on COs as you clearly didint know that a payment plan is usually set up as a condition... you didnt know that if the paymetn plan is broken by the debtor, then you could apply to the court for an order of sale..

    Unfortunately, business is a risk and I really dont think that this will be the only time you will be 'ripped' off... so, maybe you need to read up on what options are available to you for when this happens again...

    And one last point - you know nothing about this man and make loads of value judgements against him.. Do you know why he didnt pay the other company..? - perhaps the work was shoddy... perhaps your was.... perhaps your only telling half a story..

    Perhaps since he got the work done, he has fallen on hard/harder times, maybe he has depression or mental or physical illness preventing him from working.. Been made redundant... who knows... but as has been said, BR is not an easy option and I certainly only give sympathy to people going BR on a BR board...

    I dont understand about CCJ's or CO's because I have never had to before. Thats was one of my reasons for coming on the board, for advice.

    I am still in the process of getting the CO, so will hopefully get a payment order soon - I did not know that before I went for the CO I thought that I would have to wait until he sold up.

    As the man is reasonably local to us, I have seen him on several occasions, driving his car, shopping etc. if he has been made redundant then that would be sad for him but there is a factory up the road desperate for staff all the time - he could easily do that. If he is ill, he has my sympathy, but why should I pay for him to be ill??? if I was ill I couldnt just not pay my bills!

    I know a lot about this man - I paid a private detective (a friend) to find out about him, which was why I found out about the other CCJ - I do know what it was for, but wont say on here, believe me it is not good)

    He offered to pay us a pound a month for goodness sake!!!

    If our work was shoddy then he would have complained about that- he has never contested the amount owed - he just wont pay it. If there was anything wrong with our work then we would have gone back and made it right.
  • many people have already said this, but I for one did NOT take BR lightly. In fact, I paid all my creditors up until the date of the BR when I was told to stop by OR and went without any luxuries in fact went without a lot of 'everyday' essentials so that my children could eat. It too annoys me when I hear of people having luxury lifestyles after BR. My husband an myself have always worked hard too, I work in a very stressful job with long hours and not much financial reward, but found myself BR through circumstance not greed. I wish you could have a bit more empathy for other people 'lifeisbutadream' as ;

    'there but for the grace of god (or whatever you believe in ) go I'!!!

    I think the points being made really are that there are some who don't care who they hurt through bankruptcy and some who go bankrupt and do feel guilty about it but have no choice. You can't pool everyone the same.

    I hope that your business keeps going lifeisbutadream and wish you every success for the future. I would take on board the suggestions aboiut asking for deposits in future. Good sound advice

    this is a great point, sorry lifeisbutadream but you do come across as bitter and this is only ever going to hurt you, if the actions against you were deliberate then the guy is not getting eaten up about it, only you are.

    Er - slight difference there - I am quite happy to pay a small percentage of my income to ensure that everyone gets healthcare, but dont really think its fair to expect me to pay a huge lump sum for someone that I dont even know!
  • I'm just talking about the general socialist theory of those earnng money through tax paying for those with problems, (ill health, bankruptcy,etc) rather than the 'I'm alright Jack' capitalist ideal.:)

    Actually I feel a lot less hurt when I am doing something about it.

    If I had walked away, THEN it would have eaten up at me.
