Hi we have recently received a letter from Martin Kaye telling us that we may have been sold with unfair contract terms in between 1995 & 31 October 2004 by Carrington Carr, an spppi. When I went through my records it seems we paid over £6000 spppi when we remortgaged with Northern Rock in August 2003. Can anyone advise us on our next step? Can we claim it back as it was pre November 04? Are we best going through Martin Kaye or do it ourselves?0

Single premium PPI is regarded as mis-sale in the majority of cases. It is an easy complaint.
However, your sale is pre-regulation. So, unless it is an L&G product you were sold, then you wont be able to complain. L&G took on liability for the L&G products CC sold but not any non L&G products. If it is an L&G product then complain to L&G.I am an Independent Financial Adviser (IFA). Dunstonh - have you checked with FOS recently? I think you will find information given to previous poster is incorrect.

From Aug 03 to M-day, the product packager (between underwriter and seller) is on the hook - not LGPS.

Nothing has changed. Single premium MPPI was always been frowned upon. It should have been monthly premium MPPI (typically paid by direct debit from your current account). This is how good MPPi is set up.2. What do they mean by 'unfair Contract terms'? - is this just tactics to try to hook us & get us to call.
its a tactic to get you to call them. The contract terms are not unfair. How it was set up was wrong.3. I've read in some of these threads it may also be possible to claim regarding the lifetime fee, is that possible here?

So is the letter correct in that we can raise a complaint against the pre Nov 2004 mis-sold SPPPI? or are chances less than slim?
Yes we paid their one off fee - it was also added to the mortgage.
If I remember correctly when we used them we went from a £42K mortgage to a £56K one, the rep said we had to consolidate a car loan onto the mortgage (so I am now still paying for a car I no longer have!), then there was the SPPPI premium, their fee, plus the early settlement fee for the original mortgage. I know now we made a big mistake using them!
