Oh I see what you mean, I thought you meant that you didn't think my sons case had merit, so therefore proving it would have been an uphill struggle, which to be truthful it wasn't from a factual point of view, however emotionally it took it's tolll on the whole family.

Oh and I thought it was over ... what did you mean by your last sentence "it isn't over yet"?

Oh and the only reason they believed our son was because they had said, and continued to say that the interview took place on the 23rd October. It was only when we presented them with our sons sick note for that period, in addition to showing them that his RTW was held on the 25th which was his first day back, that the managers became unsure of the date. So I guess that's why my sons evidence was preferred on the date issue. Regarding the other reasons they believed our son, I guess it's because they lied about some of the procedures that were carried out, disputes over comments and some of the comments that were made by both Mr Patel and Ms Shipley.

The tribunal is over, and it is an impressive win, but we still don't know what the outcome for him is, in terms of getting the support he needs and the managers treating him with the respect that he deserves.

Unfortunately I agree with you. We're really hoping that the ET will recommend the previous reasonable adjustments and the additional help he used to have. Obviously in addition to that we are hoping that some recommendations are made regarding the way in which policies are enforced. I agree the case is over, but he still has all the practical issues to deal with. At least with the case being over, that's one hurdle out of the way.
