jsis, were you on their site looking for a loan? If you didn't enter your details onto the site (or a partner site) then the removal of funds is theft. You claim it was a phishing scam - have you reported the matter to the police? Did you give your details out to a third party and have them sold on? Or did you put them in, not realising what would happen?
If you entered your details and just didn't realise the money would be taken so quickly, then it's not a scam - you made a mistake in signing up. I wish you luck in getting your money back, and hope you succeed. However, people need to stop making mistakes of their own volition and calling the other party scammers.
The comments about your post were valid, if not kindly put. If you want to get a point across, making it legible would be of great help to other forum users. You must understand that we get a great deal of 'ranters' on the boards, and some posts are very hard to follow.
With regard to the woman who had her money taken - if she signed up for it, it's nothing to do with human rights. Sorry, but that's the bit I'd take issue with you for. For heaven's sake, people need to stop screaming about human rights every time someone does something stupid and gets taken advantage of. She gave the money to a loan company rather than feed her kids with it. How is that the loan company's fault? They don't have to refund it (legally) if they provide the service. The service might be shoddy, but she agreed. I think they should be shut down for moral reasons, but legally, until they are stopped, people will be dumb/desperate enough to use them and you can't stop them taking the money.

Firstly here is a note I recently recieved from a 'lucky' customer that managed to get refunded.
'hi every1 just a quick note here 2 say i finally got my refund minus 5quid which im not bothered about, all i did was email katie @ myloan.co.uk every day demanding my money threatening them with police etc and on my 32nd day after cancellation it was finally in my bank so dont give up any1 keep emailling every day until u get it no matter how rude she is u will win gd luck'
However in my case I did not recieve any replies to emails to telephone calls so I reported them to Greater Manchester Police:-

The problem with this company is that in most cases they have taken advantage of peoples details and then charged them without consent.
The main complaint from people is that they never visited any of the above sites in the first place and don't remember agreeing to anything,
and then next they know is they are minus £69.99 and recieve an SMS telling them 'Thanks.We have taken your first payment.You may now
log into an account we have created for you using your name and postcode'
Not only is this very worrying but on some occasions people have had more than one payment taken leaving them penniless.
In my case - I'd just been paid and they took half of my wages.It ISN'T right and it IS fraud,and they need to be stopped.

Hi, we've just been charged the £69.99, and we haven't even visited their site, Nationwide wouldn't help and said that it's not fraud as no other companies had taken any money? If it's not fraud then what is it?0

I may have been naive and not wary enough when applying for a loan but I'm not stupid and I am assuming the authors of the endless posts who have been similarly scammed by Myloan are not stupid either. There is no way I would have knowingly agreed to pay them an upfront fee of £69 in return passing my details to lenders who are freely available to apply to directly to when I was only looking for a loan of £100. Yes yes yes, people should be very wary when giving their card details online, but cmon surely it is Myloan who deserve your scorn not the people they have managed to scam.0 -
just had a bank statement with a payment to this company, myloans.com for £69.99. I haven't taken any loan, just looked, a £1 payment has gone out, the £69.99 and the bank has said they have tried a couple of times!!! Can I get this money back?? I've noticed some people have 'finally' got money back but that was months ago...will it still be the same process? Any advice welcome0

I am totally riled that this company can just keep hold of our money, I got ripped off a couple of weeks ago and have sent them a cancellation.
I have the details of some of their employees that I have been in contact with and have traced them on facebook. I am wondering if I can threaten them that I will smear their names and details across facebook and tell all their friends how they make their money if I do not get my refund.
I am wondering if there are any laws against me doing this?

very shaky legal ground - the sole employees aren't to blame. your gripe is with the company, not the individuals. you could be going down the routes of harrasment and various other illegalities.helpful tips

Absolutely making no judgement on anyone using this site but isn't it all there in the FAQ's? Amongst other questions it says...
"Q. Do you take a fee?
A. We do ask for a small fee to cover our processing costs so we won't limit our search. We feel we offer real value to our clients by searching the entire UK market for the best possible loan to meet your circumstances."
Putting aside the ethical nature of sites like this, I read this as the fee is payable for the search to be conducted, i.e. at the start of the process. And it is very clear that this 'small' fee is £69.99 right on the front page.
It can never be said enough, read the small print, read the small print, read the small print..................0 -
I do accept that I did make a big boo boo by not checking carefully I was desperate and thought the site was a comparison site (which was what I googled).
I personally would not have signed up for anything that said I had to pay £70 when I was looking for only £100 loan in the first place.
Thanks to the other posters. I now see that chasing the individuals is probably not the best idea. I have resorted to sending an email to all of the company email addresses I have of theirs I have every 5 mins...
They have told me that I will receive a refund and this will be processed on the 17th October. Which is exactly 30 days since I cancelled the terms and conditions I inadvertently signed up for. They have said that it will take 1-5 days to clear into my account. This is illegal and in contravention of the The Financial Services (Distance Marketing) Regulations 2004 which states I should receive my refund either as soon as possible or not extending 30 days. Regulation 13 states...
Payment for services provided before cancellation
13.—(1) This regulation applies where a cancellation event occurs in relation to a distance contract.
(2) In this regulation, “cancellation event” means the cancellation of a distance contract under regulation 9 or 12.
(3) The supplier shall refund any sum paid by or on behalf of the consumer under or in relation to the contract to the person by whom it was paid, less any charge made in accordance with paragraph (6), as soon as possible and in any event within a period not exceeding 30 calendar days beginning with—
(a)the day on which the cancellation event occurred; or
(b)if the supplier proves that this is later—
(i)in the case of a contract cancelled under regulation 9, the day on which the supplier in fact received the notice of cancellation, or
(ii)in the case of an attached contract under which the supplier is not the supplier under the main contract, the day on which, pursuant to regulation 12(3)(b) or (5)(b), he was in fact informed by the supplier under the main contract of the cancellation of the main contract.
These people are unethical and make their money from tricking vulnerable desperate people.0
