Thanks guys! I'm going to leave a week to see what happens and then think about it. They have one argument I'm not sure I can win - that there were terms and conditions with the visitor pass that I wasn't aware of. I don't believe it's legal to have terms and conditions which aren't displayed in the car park - am I wrong about that?
The other thing is that, at the end of the day, it is only a guest permit and I don't want to cause problems for the owner, which this will if they get their permits cancelled. I think I'll wait and see what Gunwharf say (if anything) and base my action on that.

They certainly cannot TRY and enforce unpublished T & Cs.
But you are missing the point. They have no right in law to impose any form of penalty, whether or not there is a breach.
Anyway, as long as you're clear you don't owe them anything- for that reason!0 -

Sorry but think what better things you could have done rather than take a fake PCN seriously. You only had to read the top sticky thread 'PPC letters & threats' and watch the Watchdog clip on there (NOT the parking ticket guide...read the top sticky & watch the youtube clip).
Apparently Watchdog are covering this scam again in part next week, to do with the scandal that allows these 'companies' to get our private data just because they 'farm' car reg numbers in car parks.
Only ever take seriously a real ticket from the Police, Transport for London, a Council or occasionally a Train Operator issuing their own real penalty parking tickets.
Any 'PCN' from a private company with no Council logo and the sneaky use of the words 'Parking Charge' instead of the real 'Penalty Charge' Notice to make up the acronym PCN, isn't worth the paper it's written on. We tell people this on here every single day.

It is pleasing to note that the previous operators on this site, our old friends Shoal Enforcement, who were stripped of their BPA AOS membership following the royal protection clamping debacle at this same development, have been succeeded by so worthy an operator as Capital 2 Coast.
Capital have been around for a while and have enjoyed something of a close working relationship with another PPC - Napier Parking (run by members of the well-known de Savary family) where they managed a car park owned by NP in Billingshurst (Jengers Mead). There, they earned themselves a reputation for ruthless clamping which ceased only after a two year campaign by locals to be replaced by £80 tickets. Frying pan and fire come to mind.
One hopes that their activities at Gunwharf will not take another two years.
The residential areas (to the south of the shopping centre - in the area immeidately beneath what is known locally as Lipstick Tower) are not managed by and, as far as I am aware, have no connection with Gunwharf Quays centre. To the best of my knowledge the residential areas are managed by Peverell OM or one of the myriad management companies in what was the old McCarthy & Stone/Peverell estate conglomerate before parts of it went into adminstration. Approaching Gunwharf Quays is unlikely to be at all useful.
C2C is in reality one Matthew Croft and Gavin Price who hail from the Brighton/Peacehaven area. Given that operating in Portsmouth is a bit of a stretch (though they also operate in S. London so it might not be) one wonders whether they have enlisted the assistance of a loal contractor? Are you driving an unmarked van again Mr Eames?
@OP is there any chance of you reducing the size of the pictures you have posted into this thread?My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

I was wondering what your result was of not paying the fine? I live in a block of flats in Crawley and have just gone to my car to find a £100 pound fine on my window! My parking permit could just about be seen as it had slipped down the dashboard slightly. The capital2coast logo was visible and the hologram. Who even gave me the ticket put it right over where you could slightly see my permit!! They are saying I cannot appeal as it is my responsibility to ensure it is visible ( I understand this however there is no signs in the car park and I was never told when receiving the permit) so I'm not happy to pay when I am allowed to park here!! Any advice would be very appreciated. I work for a finance company so any court summons would really affect any promotions so I need to be careful.0 -
It's not a FINE! As for a court summons, you seem to be confusing a criminal court with the County Court.
So, just ignore them. You don't owe them a penny and it won't go to court.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -

This is NOT a parking ticket, NOT a fine at all.
This is a scam company slapping useless pieces of paper on cars and hoping that a percentage of nutters will pay them, or that others will appeal and give them a name and address to spam with debt collector threatograms!
Can't see Capital 2 Coast on the BPA approved operators members list although there is a 'CapitalCarParkControl' (what's on the fake PCN?):

That will mean they can't get your name & address from the DVLA.
As you are worried, to put your mind at rest, email the addy below with a copy of your 'ticket' and ask to double check that this firm are not AOS members so can the DVLA please reassure you that they would not divulge your data to this lot:

Let us know what happens and certainly if they send the registered keeper any letters, because a non AOS member parking company legally CANNOT.

Ignore them, they cannot get your address details as they are not in the BPA AOS. The only way they can get your details is if you tell them, or they break the law and use another company to do it for them.Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!

Oh dear they do sort of land themselves in it, what a pile of bulls manure this isFixed Charge NoticesThis service involves our uniformed staff patrolling the location and any vehicle found to be in breach of the restrictions will be issued a fixed charge notice of £100.00 if paid within 28 days of issue and reduced by 40% to £60.00 if paid within 14 days of issue if the payment is not received or the fixed charge notice has not been challenged within 28 days then under the Protection of Freedoms Act 2012 Capital 2 Coast will request the vehicle keeper details from the DVLA and start civil court proceedings against either the registered keeper of the vehicle or the driver at the time of the event to recover the debt. The registered keeper is now legally responsible to provide us valid contact details of the driver if it wasn't themselves driving. We may chose to use our appointed debt recovery specialist to try to recover the debt prior to issuing court proceedings both may incur further costs.
