GM might get involved on a good will basis but the contract is with the dealer and it is the dealer that is bound by the quality and durability requirements of sale of goods act.

In the first six months the dealer has to prove that any faults weren't there at the point of sale, after the first six months you have to prove the faults were there at the point of sale.

If this was a bit of machinery that rotated or did something I'd say you will have an uphill battle on your hands proving when the fault occurred but as the manifold is just a lump of metal that generally would just sit there until it rusted away I'd say the fact that it has cracked (and seems to be a common fault) is indicative of a design/manufacturing fault which has been there (abet latently) since the car was manufactured and so the dealer should repair free of charge.

As someone else said, try and get the dealer on your side with regard to getting GM to sort it but if that doesn't work then I'd certainly have a go at the dealer under sale of goods

There car is four years old and out of warranty and your friend has had it for almost a year.

VX are not going to repair this for free, unless there has been a known problem and massive failure rate. You need to accept and understand this before you can move on.

Once you have accepted the above statement, you can then start looking at your options, which is to hope for some goodwill payment. My advice when trying to get something for nothing is to be pleasant to people, as it's always harder to say no to people who are being nice.

Do not bypass the dealer (not at this stage) if he is a direct franchised VX dealer. Remember, whatever happens, he is likely to be doing the work on the car, so you want to maintain good relations at all times. Contact the dealer and ask them to contact VX and ask for some sort of goodwill payment. Personally, I think if you get anything, you'll be doing well, so don't set your sights on something like 75%.

If the dealer refuses to contact VX, put it in writing to them. If the reply from VX is unsatisfactory or the dealer refuses to contact VX, then contact VX directly in writing and then follow up by phone a few days later.

Be reasonable at all times and state your case clearly and concisely as to why you feel that they should make a contribution.

If you have no idea of what you are talking about dont comment. Wether its driven in anger once or on more than a few occasions is irrelevant, as the parts fitted to it should be fit for the purpose it is intended to be used for. (Nurburgring edition, does that give you any clues?!) And as its fully serviced with main dealers and obviously doesn't do that many miles, it should not have failed so quickly.

You dont build a hot hatch to drive it like a granny. So it should be adequately built to with stand the type of use it would be expected to have...

OP, you have asked a question which has been correctly answered, it might sting to hear it but your friend is not covered.

There is no need to blame other members for the situation, that you don't like the answer is fair enough, but it really is not any posters fault that it is NOT covered, that's just the way the wafer crumbles.

The question has been correctly answered for you, we could all lie and give you the answer you want to hear, but what would be the point in that?

By all means disagree with the replies and go find out for yourself, you could always try ranting at more official advisor's about it and hope they turn around and say "Ok, we will change our minds about it for you". But its not very likely to change the situation as it stands.
