    Little different in Napiers case they own, or another of their companies own the land.

    Still one case in how many? Plus what was the point £190 then £90 loped off for wasted witness expenses so £100 then they pay for a transcript. Good business practice not!

    This case was heard before the VCS v HMRC judgment was given, I believe.

    It's certainly a strange one: the defendant paid to park using the P&D machine, but took 17 minutes to do so, and on that basis the Judge decided that £80 was a reasonable pre-estimate of the PPC's losses. I fail to see how they lost anything at all.

    He then knocked £100 off the PPC claim due to wasted costs for a previous aborted hearing. Again, very unusual practice for a small claims court.

    As I said when the FOI figures were revealed, with so few of these claims actually reaching a contested hearing, it's not surprising that some Judges are unfamiliar with the legal niceties, and can make bizarre rulings in some cases.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx.     Thanks a bizarre but really funny judgment for them to quote and get a transcript from. Smacks of desperation! :rotfl:

    The guy got £90 back for wasted time so only paid a little over the original fake fine! And Napier consulted a barrister as well (v. expensive, as well as the typed transcript cost too!).

    Following on from GTFA's comment previously the Morrisons store in Rhyl has a P&D machine were you have to pay a quid to park. The ticket comes in two parts, one part goes in the car and other you tear off and take with you. When you pay at the till you had over the torn off bit and get a quid knocked off your bill. So the car park is free providing you spend at least a quid in the shop.

    This is still basically a scam though rather than anything to do with car park "management" as the car park is way too big for the store so it's rarely more than half-full and therefore has need to be "managed".

    Now wouldn't it be awful if every week we all posted this in an unstamped envelope to DR+ and another to Zenith Collections just in case the the scammer is cross dressing on that day.

    A few dozen of these every week for a few months would be quite annoying I would think.

    So please don't take this post as a suggestion that any of you should do such a thing. ;)

    It is nice to see the value of your house going up'' Why ?
    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.
