Very unlikely if the retailer has provision for disabled customers, but that provision is temporarily full.Parents with kids do NOT actually need P&C bays, it's all a PR exercise. And, as I said, I have 4 kids, so I do know. You can use a normal bay!0 -
A retailer was apparently forced to pay a hefty amount to a disabled person who was about to sue them for usually-full disabled bays. I say 'apparently' because I read it on CAG forums a couple of years ago and have no actual knowledge of the case. It's perfectly possible under the law.
Quite right too for the disabled person to pursue this in the right way, good on them for getting a settlement and the bay issue taken seriously!
A reasonable adustment such as provision of disabled bays has to be adequate otherwise it's just paying lip service to disability law. And the retailer has a duty to review these adjustments. If a service/retailer finds that disabled bay are nearly always full then it means they need more, simple answer (not assume like so many uninformed judgmental people do, that the bays are necessarily being abused by able bodied people!!).
But I know that's what some bright spark will think when thy read this, having not cottoned on to the fact that disabled people don't even need a Blue Badge legally to use these provisions...any more than they need a visible disability, wheelchair or whatever.
Bottom line is that disabled bays matter. Parent and Child bays don't.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Looks like Haswell is at it again
Northampton is just the processing centre.
You should register on pepipoo and post up the details of the claim on there minus the personal details.
With regards to the claim please reply on the court website (by logging in) advising that you will defend the claim in full and that you wish to apply for extra time(that gives you the full time to get the defence together plus any more info u may need from ukcps)
On pepipoo msg someone call Alexis who will help you compile all the information you need to defend the claim, or you can message him on here instead, his username on here is AlexisV,. watch out though for newbies offering help as it is likely to be Haswell trying to get info on (haswell is ukcps manager)For everthing else there's mastercard.

The usual advice is to ignore everything unless your one of the rare people who get real court papers.
do not worry.
check they are real by logging in to money claim online, or contacting the court.
again do not worry or panic
next up be honest and tell the truth, dont try and hide behind feeble excuses such as prove i was driving ( unless of course you realy were not driving)
take advice form others on here, and else where, and read up on other cases that have gone to court - such as the dont forget your toothbrush case.
Next question, were all of the disabled parking spaces taken up? in other words by using a disabled bay did you stop someone else from using a disabled space?From the Plain Language Commission:
