Hi everyone,
Been a while since I got my initial notice and I like to pop back from time to time... In the post today, I received my 'final demand prior to court action' after their last letter which was 'final notice to owner', so it would seem their being very generous and giving me a lot of time to pay up before they force me to in court
.... As you can see from the previous posts, I was a worrier, no longer! It does still stress me out a lot having to explain things to people who ask about the issue on a daily basis, like parents and teachers but I now know that nothing will come of this... Just thought I'd interact with the forum again and update everyone at the same time!
Also, another thing I found quite amusing/confusing is the fact that the 'notice to owner' was addressed to me and I'm not the owner of the car, my dad is. Clearly, they have used the details I provided in my challenge appeal (before I found the forum) instead of going through the DVLA... Is there anything legally wrong with sending me this owner letter rather than my dad?0 -
I dont think it matters one bit, although it has obviously caused you some distress, worry, and ( probably ) upset, have you thoght about putting a claim in for harrasment?
you should claim agains botht the parking company, and those that allow them to opperate on their land as they ( the car park owners ) are liable for the actions of their agents.
going just for the car park company may result in a payout and compensation, if things go your way.
however this will be a minor thing to the parking company as their parking charge/fake ticketing activities will generate much more than they ever loose.
If you go for the land owner/ whoever permitted them to operate there ( as they are also liable ) then potentialy they will get irrritated by the PPC, and the PPC could possibly be botted off the car park come contract rennewal time (or maybe sooner)
Instead of directing anger against the parking compnay you should direct it against those that allow them to opperate, and in turn aprove of their methods.
In doing so you will be doing something good for society as a whole.From the Plain Language Commission:

Hi, I had considered the harrasment claim because of the advice of FA but im not really sure how to go about it, also, whether or not I would have enough evidence or anything like that... Tbh, I had a few concerns because of the fact that I hadn't come across any people who had successfully claimed for harrasment but I am very much open to and in favour of the idea if there's a good chance that I'd have a case. Thanks.0

Hi, I have sent a letter to excel before (drawn up by FA, again, thanks to him) about the letters I was expecting and the fact that I would much prefer a quick court case, but they have decided to not take me seriously about the warning of a harrasment claim which I also illuded to in the letter so I'm not really sure on my next move... Of course, I can easily ignore and nothing will come of it but I also have the option of the harrasment claim... I don't think I'd go with your suggestion though, however amusing it isbecause of course its not a foregone conclusion that they interfered with the car lol, would they do that? And also, there is CCTV in operation and it is has a great view of where my car was parked, surely the attendant wouldn't be that stupid? Also, I was in a rush that day, so it wouldn't surprise me if I had left the permits in a less stable position than usual, on display none the less though!

Yes, I think that Excel have been downright despicable here (nothing new, then) and it is time for LBA. You will also need to send one to the College as they are responsible for their agents. To find out what sort of uncouth thugs they have contracted to manage the car parking in an educational establishment may come as something of a shock to them, especially as it will lead to a claim being made against them as a result.0 -

both the PPC and the people who allow them to opperate are liable, so a letter to both is the way to go.
Have you tried talking to someone at the college directly? if possible, you could hand the letter to the person directly, this will make sure that they have received it, and it will save some money on stamps.
it may be worth while to see what they say after reading the letter as well, and reporting back on here how you got on.From the Plain Language Commission:
