second hand car problems!

Help!

My partner bought a new car on Saturday and when he was driving home it lost power. Sunday when we took it out for a drive a error came up on the dash board. We took the car to a local garage to get looked at and was told the turbo has about had it and there a rattle in the gear box. We have since contacted the garage where we purchased it from and have been told because we took it "sold as seen" and for a reduced price there is no warranty.

Ideally we'd like our money back for the car but what are our rights?

which one of you inspected it found faults and asked for a discount on account of the faults present and signed the receipt accepting it as sold with faults then?
  • There was no faults with the engine when my other half drove off and he signed the paperwork. He asked for discount due to a small dint on the rear passenger door.

Sold as seen isn't worth the paper it's written on!

OP, you need to write to the garage rejecting the car, outlining all the faults. They are within their rights to repair the faults rather than refund.

Have a read of this: http://www.direct.gov.uk/en/Governmentcitizensandrights/Consumerrights/Buyingacar-yourconsumerrights/DG_183047
  • The dealership said that if the engine light comes on again then to take it back for them to look at. I'm worried about driving it back to them incase the turbo goes and then we get stuck!

right so they are willing to help good
get the car transported back to their premises and go with it
let them see the problem as it is
    do not drive it there
make them tell you what they are going to do not what you want them to do
do all this tomorrow and dont do any texting to them ,make sure they are there and turn up
this way they can see you are not a walk over
  • We live in Nottingham and bought the car from Northampton so getting the car back there will be a problem without driving it and me and the other half both work full time

If you want it sorting you're gonna have to do some of the leg work yourself unfortunately ;)

    bit of a problem then
write a letter not an email
outline all the faults and the reasons you are rejecting the car but give them room to offer a repair of these faults at this stage
tell them due to the turbo fault and the fact you are frightened it will go bang that the best option is for them to arrange collection
    send this recorded delivery
also speak to consumer direct and see what they say
keep records of everything you say to whom where and when
you might need this in the months to come
get the advert details too before its taken down
  • I've got the advert details I printed those off earlier! I'd rather them let us take it to a garage of our choice (thats local) and then them settle up the bill. Do you think they would go with this option?
