You don't seem to appreciate that there's a matter of luck involved in getting the number. I googled for it, got a RM number which didn't get me to it. hermum found it but had better luck than me. The phone number was engaged all day long. Can you please stop posting on this thread if all you're going to do is be offensive.
Google isn't a luck search. Hermum wasnt lucky - she just wasn't lazy.
Go back and look at the times.

You are being of no help on this matter. First you object to me stating that the line is always engaged claiming that it was only ten minutes between hermum posting the phone number and me stating this. In fact if you look at the times of the post it was 22 minutes. And the phone was engaged all day.
But your latest response is worse. You have completely failed to consider my point, just stating "oh you don't understand" without any back up to your arguments. Can you also please stop posting on this thread.0 -

The issue you have is admitting someone else's liability, if your building is classed as a multi-drop (or multi-residence) location both the seller and RM have fulfilled their obligation to you.
If you don't then it's a tricky one and whilst it's obviously a great shame for you to be out-of-pocket, the same goes for RM and/or the seller. Your neighbour is the one who should foot the bill, I'm not sure what side the law would be on but you'll need to take the seller to the small claims court to find out.
If it were me I'd ask the neighbour exactly what time they left the parcel outside and mention you are going to the police, then go a report the theft and get a crime reference number.In the game of chess you can never let your adversary see your pieces0 -

I went out for lunch at more or less the same time as this.OK, after quite a bit of investigation it seems that what happened was that the phone was delivered to a neighbour of mine who just left it in the communal hallway. Bright spark. And someone has just walked off with it. I'm hoping the Post Office will reimburse me, after all their obligation is to deliver it to me, not to my neighbour.
First of all none of your neighbours had taken delivery of it for you.
I'm assuming that you weren't out for lunch for hours, especially when you were expecting a delivery.
In the half hour, or whatever you were out, the postman came, found a neighbour who happened to be home, left package & carried on with their round.
Stupid neighbour, who forgot they'd accepted a parcel for you, left it in a communal hall. Someone else came along & stole the packet. It all seems a bit suspect to me.
How did you get the neighbour to remember taking it in? Maybe if you question them a little further, they'll remember putting it in their cupboard or something.
Are you in a huge block of flats with hundreds of people milling around all day?0 -

I have too many neighbours to ask them all. The parcel was accepted by a neighbour whom I don't know and I really wouldn't have expected to accept the parcel.
Anyway, I appealed the eBay decision, quoting the Sale of Goods Act and they have now given a full refund.0
