Dublin M50 Toll Penalty Enforceable?
Comments

Found an article saying that "U.K. drivers won't be able to avoid the tolls as they will be passed to a debt collection company". Good old Guardian. Once it's in the hands of a debt collection agency then we are back into standard instructions- ignore, ignore, ignore, till they go away.

Is this still the case that its best to ignore EPC PLC? I had a charge for £43 from the M50 toll!!!0

Ignore all private companies. Once it is in the hands of a debt collector nothing happens.0

Dear All,
Just got scary letter relating to M50 toll charges from EPCplc adding a whopping 202.67 of Unpaid Toll Notice.
I am convinced I paid these tolls at the time in a local Garveys garage, however the advice from here and pepipoo.com is to just ignore this letter.
Obviously am a little scared to do this, but I have been told that it will be worse for me if I try and engage with these cowboys.
Will this affect my credit rating as a 'bad debt'? Have they got any comeback if I don't pay?
Do I even let them know I have no intention of paying this? Advice would be gratefully received0 -
As far as i know, debty collection agencys can only affect your credit file if and only if they manage to take you to court, you loose and you fail to pay up - following this, and only after this can they apply for a CCJ (coutny court judgement ) which will then have a negative effect on your credit file. As you can see theres quite a few hurdles to jump first, and some of those are virtualy impossible (court/loose//dont pay etc)From the Plain Language Commission:

Hey there.
I recently received a letter from eflow stating that I owed £124.83 (£8.13 in tolls and the remainder in penalties!)
I'm VERY happy to report that I appealed and was allowed to simply pay the toll charges, which I did over the phone this morning.
I'm going to copy and paste the email I wrote and the reply I received so that others might do the same.

Hello.
I am in receipt of a letter dated 22/02/14 informing me of unpaid tolls.
Firstly, I am quite happy to pay the three toll charges. The toll charges come to £8.13 (three separate tolls of £2.71 each).
What I would like to dispute is the penalties that have been applied:
Total STR Penalties £7.86
Total UTN Penalties £108.84
My story: I made several trips to Galway, Ireland last year to visit my parents in law. I live in England where tolls are paid via toll booths and I feel I have been unfairly caught out by the automatic toll system operating in Dublin.
In January I moved apartment, and it was only yesterday (28/03/2014) that I was informed that there was a letter waiting for me at my previous address. The letter states that a Standard Toll Request was previously issued to me, but I have never received this, so I was in ignorance of the fact that I had any charges to pay.
I certainly DO want to pay back the tolls I incurred; I have no intention of avoiding public road user charges.
I will be happy to set up a video account in order to avoid this situation in future.
Please would you advise me by return email what I need to do to:
a) Set up a video account
b) Apply to have the penalty charges waived
Thank you for your time.
Kind regards,

Dear Ms X
Thank you for contacting eFlow Customer Service.
With reference to your email, received on 29th March 2014, I have reviewed the transactions for your vehicle xxxxxxx.
Between 4th August 2013 and 31st December 2013, four journeys were not paid within in the required period and then passed to our legal team, Pierse Fitzgibbon Solicitors, for review. As these journeys were the first unpaid passages made by the vehicle, we would be willing to reduce the total amount for each passage to the original toll rate and first penalty amount (STR).
Please contact Pierse Fitzgibbon Solicitors on 00 353 68 50967 (from Northern Ireland, UK and overseas) to make payment for these journeys and then a registered account can be set up for the vehicle.
If you have any further queries, please contact us using the options below.
Yours sincerely

I'm not going to set up a video account, but threw that in as it showed 'good will'.
Good luck to all those who make an appeal.0 -
Have you also paid the first penalty of £7.86, as they seem to asking for that in addition to the toll fees.As these journeys were the first unpaid passages made by the vehicle, we would be willing to reduce the total amount for each passage to the original toll rate and first penalty amount (STR).
If the invoice is from Dublin, why are they not quoting prices in Euros? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

We travelled on this very road last year and whilst talking to the locals in the pubs about this toll every last one of them stated they never ever pay this charge and told us to ignore it as nothing ever happens they said, we did in fact pay as we were in a hire car and so had no control over events.0

Yes, I did pay the first penalty of £7.86 as I wasn't going to argue the toss over that.
The price was quoted in British pounds as, presumably, they figured that if I'm going to be paying with a British bank account it makes sense to quote the price in British money.0 -
99% of the time the penalties are wavied for UK motorists. The problem is that the terminals in shops in Ireland cannot handle UK VRMs. If you offer to pay the tolls they will accept.0
