Norfolk police Hq can be called on 01953 424242. They dont advertise it but its a local number so is inclusive on many landline and mobile contracts (saynoto0870.com)
The 0845 456 4567 number they had plastered on cars can be charged at upto 31p on a mobile per minute

The 101 number is 15p for the call.

No tell the bank to stop being ignorant useless muppets and chargeback the card. if the operator refuses ask to speak to their manager. If that doesnt work ask to speak to the card fraud team who will do it.
(also did you pay them with your card on scene with a mobile terminal or did you phone and make payment and they came to you with the receipt?

I did make the payment by mobile terminal, yes.
  • They're saying as I paid by chip and pin that I can't claim it back. Still on the phone, any ideas?

Ask them to quote the policy to you

  • Right - I spoke to the team leader and they told me that as the payment was made using chip and pin I made the conscious choice to get my car released and so it was not under duress at all - I made the choice to release my car, I wasn't held at knife point or anything.
She said there's absolutely nothing they can do as it was not under duress and as I firstly made the choice to have my car released (she said I could have simply let them have it) and secondly used chip and pin so authorised the transaction myself that they couldn't do a chargeback.

    Very disappointed!
  • Keep pushing them. How does she know you weren't under duress? Being deprived of your car on a dark night in an isolated place by a thug making threats (for example) is tantamount to being held at knife point.

Absolute baloney. The guys who were holding your vehicle were standing over you. You had no choice. The bank's argument is wholly illogical. Think about it. Are they seriously suggesting that because a person makes a conscious decision to hand over their property that it is therefore voluntary and there is no duress? What about the case of a person held up at gunpoint who "voluntarily" hands over their wallet and mobile? The fact that no gun was used in your case does not make there any less duress. You were being told that unless you settled their demands then and there they were taking your car. Does that not represent a metaphorical gun to your head?

But don't get too hung up on the banks being the usual self-serving institutions that they are.

Have you issued notices before action yet?
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

Hate to say I told you so but this is the position and I said this in post #54:

But where you've paid using a chip and pin the card companies won't usually allow a chargeback as 'unauthorised transaction' unless you really press the threat of a formal complaint to the Financial Ombudsman (which costs the Bank more). Lots of people have tried very hard to get chargebacks after a clamping and it's like banging your head against a brick wall, apparently.

Good to hear the personal info about these scammers though even though you are a ppc guy. And interesting if the developer is in administration.

The OP can try the chargeback but I suspect the Court threat will work better, especially enclosing a draft Small Claim made out for the amount plus expenses, court fee and interest at 8% (plus extra as damages for distress which is what WageSlave did on pepipoo). The OP may as well try even if the agent is in administration, as they are still responsible for the flats and the agents they employ there.

And to ppc_guy, lots of us have thanked you on this thread, you've been a mine of information for this OP! Especially the tip about a complaint/Court threat to Savills who may force the refund and sack the PPC!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
