But where you've paid using a chip and pin the card companies won't usually allow a chargeback as 'unauthorised transaction' unless you really press the threat of a formal complaint to the Financial Ombudsman (which costs the Bank more). Lots of people have tried very hard to get chargebacks after a clamping and it's like banging your head against a brick wall, apparently.
Good to hear the personal info about these scammers though even though you are a ppc guy. And interesting if the developer is in administration.
The OP can try the chargeback but I suspect the Court threat will work better, especially enclosing a draft Small Claim made out for the amount plus expenses, court fee and interest at 8% (plus extra as damages for distress which is what WageSlave did on pepipoo). The OP may as well try even if the agent is in administration, as they are still responsible for the flats and the agents they employ there.PRIVATE 'PCN'? Just to update you all - I sent a NBA this afternoon to the clamper himself, the clamping company and the managing agents.
Included was a draft N1 Small Claim form, in which I have claimed for the amount plus expenses, court fee, damages for distress and time spent and interest).
Now all I need to do is await a reply I guess!0 -
i will tell you now the clamper himself will not reply or if he does he will say he is carrying out the work as instructed by his employers under the terms of his employment.
Jonathon will treat it as an appeal and will send an standard appeal rejection letter (has anyone checked them for CCJ's ?)
Also if the developer in administration the administrators will reply stating that you have an unsecured claim and will be treated as such.
On another side note the contract with the site may be invalid i know Jonathon used to charge £95 per sign per year so if the year is up he may no longer be working with permission on the site ?
*Added: With regards to an operators license they dont own or have access to a tow or lift truck. If clamped you should take off a wheel that has not been clamped, put the locking nut back tight and lock the wheel in the boot leaving the car on the jack.

Well my wheel-arch is more dented than it was before (only a slight dent before, much bigger dent now) but they say on their ticket ' we hold no responsibility for damage caused whilst clamping or moving' or something to that effect. I'm pretty sure that's illegal to say though, right? It's still my car, they can't smash the windscreen in and say 'sorry, not our problem'!
There aren't any marks on the road from where it may have been dragged.0 -
They moved the car with a product called Go-jaks or a rip off version.
You put it onto the wheels jack it up with your foot and its like a giant sized skate just rolls with a simple push.
