Now to opt out of the whole scheme and to point out to the managing agent that clamping is to become a criminal offence in the Freedoms Act in a few months time (the Autumn).

Any clampers will be looking for any old excuse in the ensuing months, to grab money while they still can. Opt out.

  • What I find funny is we've all received something today telling us there will no longer be clamping, but 'penalty charge notices' !

At least that will be a lot easier to ignore. Save the letter that tells you this as it makes the charges illegal and unrecoverable. And see if you can contact your neighbours with the info. So you have successfully forced a rethink of their policy. We told you it was worth it. The next rethink if you play the cards right will be the bullet for the parking parasites.

So the managing agent or landowner kicked out the clampers (or made them stop clamping and reverty to fake ticketing) due to your case. And then they made the clampers phone you up, grovel, apologise and reimburse you in full.

Well done, that is some overall result!!!

    'Penalty Charges' ROTFL! :rotfl:

Been away, so congrats for getting money back, but yes keep this letter, and copy it. it is an absolute defence, against a PPC scamOgram, as it explicitly calls the ticket an unlawful Civil Penalty.

They may not have been but a quick call to a printing company will see you suitably equipped with professional looking versions - if you are prepared to stump up the readies. If you can't be bothered to go the whole hog and have 3-part self carbonating tickets you could just run off a few on your PC's printer. Its not difficult.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

Indeed being on the inside i know the logistics of it all but they have no methods of appeal or anything in place. Nor do they have a static card machine anywhere to process payments. Their signs are all di-bond aluminium and they have none set up for ticketing and the cost of getting them all changed over would not be financially viable.
