  • Its the OPs friend. I just cant believe that people think she she go to prison for stealing £8.00!. Its a good job the law is a bit more leniant than some on here.Its silly but not the crime of the century.
    The issue will be the lying about it- well it would have been where I worked. I think her position is untenable as the people in that company will never be o.k with her again. How can she work there after this?
    From where I am standing it looks like a dismissal so shes best off resigning.

    Theft entails an intention to permanently deprive. There was no intent here, and hence no theft.

    a sydicate for the lottery does not belong to the company. Are you seriously saying if they won the company gets the cash?

    She ran short of money for bus fare and borrowed it from the office lottery syndicate which she manages with the intention of putting it back the next day

    This is quite possibly outside the scope of the company anyway and they have no authority to even investigate.

    Is this person responsible for collecting funds, buying tickets and dishing out winnings, does it specify how the money must be stored between the 3 basic operations etc.
  • I think they can investigate all goings on of a suspect nature under their roof.
    As she was grassed up by three work colleagues, who have basically tried to get her sacked, I dont think it sounds like the nicest work environment to be in. Maybe shes better off out of it.

    This is correct, there is endless case law to confirm it.

    It is the office lottery syndicate's money. You need to work hard to show it belongs to the employer.

    If an employee was stealing other employees' wallets and purses, you would want them dealt with by the employer ... That is quite aside from the specifics of this case.

    Having said that, I think the the other syndicate members should have asked her about the matter first - and management should have told them to deal with it in the first instance.

    Have to say, it looks like a dismissal. It's a financial background, and the friend of the OP was seen to take money that wasn't theirs.

    It can be said that it was an intention to repay, but it's proving that. As the employer would see it, they've just taken the cash without informing anyone. If you work in finance, you can't do that, no matter how small the amount.
