  • I recently got cold called by a company that said I had a loan back in 2005 with HSBC that I paid off 4 years later and had PPI and they could claim for me. Although I can't remember for sure it is possible I had the loan. They said as its so old only an claims management company can claim - this didn't sound true. How do I find out if I'm entitled to compensation?

That information is not in the public domain. So, either they have your information unlawfully or they have lied to you.

no-one is entitled to compensation. That isnt how it works. You put in a complaint listing your allegations of wrongdoing and they investigate your complaint.

  • Hello,

I had a load through HSBC 8/9 years ago with PPI.
I tried claiming for the PPI in April 2013, received a questionnaire back to complete and then it went to a team to look into who got back to me weeks later saying this was rejected. I did not know at the time that a rejection was not the end of it.

I cannot find the bank statements anywhere (I think the bank kept them) and I do not know what happened to my copy of them.

Can I claim without these? I have the account number but I do not have a copy of the letter/T&Cs signed/exact dates and can only guess how much I got the load out for originally etc.

Should I let it go and move on or not?

Any help would be gratefully received as this has been on my mind with every MSE email I get!!

    :)

Unfortunately, you have six months to refer your complaint to the Ombudsman after it has been rejected by the Bank. Since you complained almost three years ago, it really doesn't make any difference whether you have statements or not as you are now far too late.
  • I realise it is far too late to go to the Ombudsman, I meant, is it worth starting a claim afresh - going through the bank etc again, or is this not possible?
    Thanks

You only get one complaint unless the bank volunteers to look at it again

Sam Vimes' Boots Theory of Socioeconomic Unfairness:

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

  • is it worth starting a claim afresh - going through the bank etc again, or is this not possible?
If you want a successful outcome (rather than simply a terse reiteration of your original rejection) you'll need to provide evidence not in your original complaint. As you don't appear to have such evidence, any new attempt seems doomed to failure again.

Don't waste any more time with this...

Up to this evening I had thought that any PPI claim must be for policies sold in the last 10 years but Martin seemed to suggest that you could claim back any date as long as you can find backing paperwork? Is that correct please.

In 1992 we took out a £40k mortgage with Abbey national which was cleared a couple of years ago. Now I distinctly remember suddenly realising the insurance policy they sold us at the same time for sickness and unemployment was useless for us as my OH was self employed. This was only some years after we had been paying it out. I wrote to them explaining I wanted to cancel the policy because my OH would not benefit as a self employed person.

So, would I, if I can find the original paperwork which hopefully is stuffed in my files with the deeds etc., be able to put in a claim for all the premiums we had paid up to the cancellation please?

yes it is right. The point of these things is draw a line under earlier debts. PPI redress is treated as an asset from before that. So, the redress belongs to them not you.
