    Evidence is key in a complaint like yours. What evidence do you have to back up your allegations? (the onus is on you to prove if the Barclaycard have nothing on file to support your allegations).

    You are also missing the point. You need evidence to show you queried it. A phone call wouldn't have been recorded them, so no evidence there.
    Then it appeared on each of your staements, but you didn't query it for another 18 years.

    You are the one making the accusation, so you are th eone who has to show evidence.

    If I said to you you owe me £40 from 20 years ago, I did phone to tell you then but you never phoned me back, would you give me some money on the strength of that alone?

    From what you're saying I guess my phone call after a couple of statements is pretty irrelevant, especially as its probably not been recorded.

    My postal application must have had a PPI section for me to sign or a tick box or something like that - something that I am saying I did not tick or sign. I am saying they added it afterwards but I don't have any evidence to show that I did not want it. So, I completely understand the points you've made.

    This would sound like a case of their word against mine and with no evidence to prove either way. I does make me wonder how people make successful claims in cases like this. You hear of people that claim back 10, 15 or even 20 years worth of PPI that they were 'mis-sold', when surely the 'evidence' from back then is weak or non-existent - as is the case with me?

    Very few complaints get upheld on the basis of he said/she said style complaints. Those that succeed with only those reasons given do so because either they get an auto payout (no investigation) or another failure is identified that they were not aware of or they have secondary reasons which cause the failure. Some failures can actually be in the sales process of the firm or the product itself or the way it is set up (e.g. single premium PPI on loans). A firm is required to look at the sale of the product on complaint even if an area hasn't been mentioned in a complaint letter. So, for example, someone with a single premium PPI using the same complaint reasons as you would likely succeed. Not for the reasons you give but because it is single premium. They wouldnt know that though as the letter sent out would just say their complaint has been upheld.

    I'm really sorry if the answer is already on here, but as there are so many responses it would take me a while to trawl through!

    I took out a 4 years interest free 'loan' with DFS and have found out that I was paying PPI on that. I have completed the form on here, and am ready to post, but do I post it to DFS or Black Horse who the loan agreement was made with (obviously it is the Salesperson at DFS who missold it)

  • I have received an offer from Natwest of repayment of PPI + interest but does anybody know if there's any 'wiggle room' on their figures - in other words is there any way I could push the figures up further? I have no way of checking if they're repaying everything that I paid in PPI.

    It is a defined calculation set by the regulator.

  • I have been waiting almost 12months for a decision from the ombudsmen as apparently they are overwelmed with claims

    Is there a realistic time in which the ombudsmen should make a decision?

    As long as it takes and it can take 18 months to 2 years.

    By the way, if you believe you haven't paid PPI it is worthwhile checking - I was nagged into checking by a bank employee who obviously knew more about their business practices than I did! :o
