A few years ago we bought a car for £3500.00 my wife took out Ppi as it was suggested that if she did not take ppi she would not get the loan, she was also told to say that she worked full time to make it easier, we got the car and paid monthly until three years were up, we paid the loan off in 2007 this was earlier than the loan should have finished, when the Ppi reclaim hit the news we decided to claim through a Ppi company, we were told that the company had gone bust however there was another avenue that could be tried, the government had a money pot for this kind of thing, recently we have been told that we cannot claim as the government did not start this pot until 2005 we bought the car late 2004

The Government do not have a pot of money for this sort of thing. There is the Financial Services Compensation scheme (FSCS) which is funded by all FCA regulated firms. It handles complaints and issues for regulated companies for transactions that started after that company became regulated.

Car dealers did not become regulated until January 2005. So, if you bought the product prior to that date, then its game over as you have no-one to complain to.

A decent claims company would have told you this rather than string you along.

Which is very common and nothing wrong with that.

So, you became sick post sale?

If you allege that it was ticked and you didnt agree it then that is a serious allegation. You will need evidence to support that as it is unlikely the firm will have anything to support your allegation. Now, if you were complaining within months after taking out the card, then that makes your complaint highly credible. However, the longer time goes on with you paying it, the less credible you become. 8 years, or nearly 100 statements, later and your complaint is not that credible.
they tell me they cant show me a agreement where do i go from here please

You don't need a copy of the agreement to complain.

  • Ok...so I'm new to this...been ignoring the tv ads and phone calls for a good few years now, but because times are a little tougher now I decided to give one agency call a chance...leading me to think I could do this myself.

Problem is I called all of my lenders and all apart from one have said that there is no ppi on my accounts (that one company said they would have to look into there archives as they couldn't find the store card i opened in 2003 on file, meaning I would have to write a letter with my details for them to start a search). I've thrown a lot of paper work out recently as we moved house so now I don't even have any paper work to show any evidence if there was any on any account.

I'm so tempted to call the agency to sort it all out but I need every penny right now. Help! Is there anything i can do?

The agency can't do anything more than you have done. You have to find out the details of your credit, then tell them, they will fill in the same form you will.

If you didn't have it, you didn't have it. If you don't believe them, you will have to send £10 and a SAR to everyone you had credit with to see if there are any records left.

  • I had ppi I think over 10yrs ago getting paperwork out of loft, I was employed at the time by a company, but was also self employed at the same time with my own company, so I guess that if I had tried to claim they would not have paid out.is it still worth trying to claim?

No idea. You haven't said what the PPI was for, who sold it to you.

been trying to claim ppi which I've been successful twice but the ppi I have wont pay out I've followed all the rules, my loan was for a car and took out ppi through the garagae the loan was with Santander when I contacted them they told me they had no account details but did give me my account number they said all rcords were deleted, I went to the ombudsmen and explained but they said although I paid my ppi to Santander they are not the underwriters foe the loan and theres nothing they can do, I feel that if I pay Santander the money then they should be accountable any advice most welcome, have even tried contacting the sun for help but to no avail

They are not accountable for mis-selling something they never sold. That would be the car dealer who I assume is either no longer trading or who has refused your complaint because it pre-dates regulation in January 2005.

I can only despair at you asking "The Sun" for help.

Your complaint has reached a dead end, I'm afraid.
