    They can do this Your options are limited. You can try complaining to the underwriter of the insurance, but it's not likely you'll succeed.
    If the underwriter says no, you can refer to the FOS. Again, it's not likely you'll succeed against the unerwriter because they didn't actually sell you the PPI.
    It may be best to chalk it up and move on.

    My bank have written to me saying they believe I may have been misold ppi on several loans I have had with them. They have asked me to complete an enclosed form to answer some questions and to ask if I want to proceed with a complaint. Is it best to continue a claim with the bank Or do I go about it another way? I'm confused as I didn't even know i had ppi :)

    Of course it is. The bank have invited you to complain, so your chances of success are already high.
  • I bought a car a few years ago and was sold ppi with it,i was told i had to have it and also i was self employed so it didnt even cover me! I have contacted blackhorse who the ppi was through but they have said its up to the car dealer to deal with, this car dealers has went bust, so i dont understand were this leaves me, please help.

    If the car dealer went bust after January 2005, you can use the FSCS. If it didn't, your complaint is over.

  • Morning MSE,

    I have had a reply to my letter regarding my PPI claim to MBNA. They have now asked the following:

    If you wish to make a request under Section 78 of the Consumer Credit Act 1974, can you please provide a Cheque for £1.00 each account.

    If you wish to make a data subject request under section 7 of the Data Protection Act 1998, please provide a cheque for £10.00

    If you require both sets of information please resend your request with a cheque for £11.00

    We return the admin fee (£1.00) and ask you to resend your request and payment with the updated information.

    I sent MBNA a letter, in the format suggested by this Website, and all the information including and a cheque for £1.00 for admin fees to provide my Account information on the PPI claim.
    So what does the above letter from them mean? I presume I only want the first (section 78 Consumer Credit Act 1974 ) information?

    Are they just stringing this out?

    Any help would be most welcome..

    There is a flaw in the template letter IIRC that can leave it open to interpretation as to whether it is a section 78 request or a DSAR request. The S78 request only gives you the right for a copy of the agreement (and only if the account is still open). If your request asked for other details as well then you need a DSAR.

    If it is an MBNA credit card, why are you asking for the agreement? PPI shows on the monthly statements if you have it. If its a loan then fair enough. Although you could just phone and ask them.
